    "Gregory" left a voicemail that included the last 4 digits of my social security number, said there have been "allegations attached to my name that have been substantiated" and he wanted to see "if I would resolve this outside of the legal system"

    I called back, identified myself using date of birth, and Gregory was talking about these allegations of "check fraud" and talked about how there were claims of "malicious intent"

    I stopped him, asked "so, are you a debt collector - why didn't you disclose this". Long story short, they are.

    I asked for a validation of the debt, they emailed me a brief letter saying I owe $777 on a debt that is currently owned by "Rocky Mountain Capital Management."

    I wrote them to say I dispute the debt, I request documentation to prove I am responsible for this debt, and documentation that they are license to collect debts in my state. Additionally to cease all contact with me.

    Had same exact experience as above by Brandon.  Call from a local number from "Greg" with NCR states there is a civil claim action that could be resolved outside of court.  Gives 888-708-9081 to call back.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  


    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
