Creditors Financial Group told me that I have to pay 3 times the amount that bounce to my bank. They draft a payment of $223.00 but this bounce, I called them and I explain my actual situation, it really really bad so they ask me a quick payment (by western union) I only sent $100.00 instead $243.00 because I can't afford to send more. Today they called me saying that I need to send the rest $143.00 in 24HRs or they are going a send me my $100.00 back and I have to pay $223.00 3 times. This is really a law in Colorado, when a check bounce from other state they can charge you the amount 3 times.

DID YOU KNOW THE WIRING MONEY IS A HUGE RED FLAG OF A SCAM?   No Legitimate debt collector would have you WIRE THE MONEY.

NEVER EVER WIRE MONEY TO PEOPLE YOU DO NOT PERSONALLY KNOW!
ITS LIKE SENDING CASH - ONCE IT GONE ITS GONE

What PROOF did they provide you about this so called "CHECK"?  Just a phone call demanding payment

Are you in COLORADO?  If not - are they licensed and bonded in YOUR state to collect?

NCO sent me letters collecting an account with Bank of America. I asked for validation, they never replied, next thing you know the account was transferred to CREDITORS FINANCIAL. I sent them a letter in January 2010, never hear from them. In June I get a letter offering a settlement. I decide to call and as soon as I say "I asked for validation and never got anything" the guy went off and got very angry and it was kinda funny. He claimed I had to call Bank of A to get validation. I just read that the creditor has to be the one to provide you validation or else they don't have right to collect. All I wanted from this guy was proof. I was not going to give my money to anyone who claims I owe them unless they can show it with documents.

You have to request the validation in writing - certified mail - return receipt (proof it was received)
YES they must PROVE you owe the debt - YOU are not required to prove that you DO NOT OWE IT.

What has happened here - NCO could not validate - so they sold the debt to Creditors, and when they cannot validatie - they will in turn sell it to another JUNK DEBT BUYER.      However you need to keep all your info on all the debt collectors that have contacted you about this so called debt - so if any of them try to sue you - you have proof that you have dealt with X number of debt collectors and none would validate

Only if they take you to court.  The "treble" damages are not automatic.

    Lamet,

You are at it again.  Yes, wiring can be a red flag.  Everything you said is true to one degree or another.  But your all caps rant isn't really all that constructive.  Try to be helpful to folks instead of ranting like a madman.  They aren't here to be beaten up, they are here because they are over their heads, and need some help.

    Laura,

They may be misrepresenting the law to you.  You only owe three times the amount if they take you to court, otherwise the penalties are substantially less.  Please look at <http://www.coloradoattorneygeneral.gov/depart ... llection_topics> to learn the details of the law.

As for where things now stand - do you have any kind of receipt showing the payment to these people ?  If so, hang on to it.  You might want to get in touch with Legal Aid where you live, or you may find help here <http://www.usattorneylegalservices.com/free-legal-aid-Colorado.html> .

Because this is a matter involving Colorado law, I am afraid I can't offer as much advice as I would like to, but perhaps the above links will help.

    Good luck.

My friend let me say 2 things.  Western Union has been in the business for quite some time and using this service is a daily event.

The 2nd is you need to learn more about what a legitimate debt collector would do before you run your pie hole and make these "STUPID" comments.  Letters and complete documentation are always provided were I work.

Does the word "DEBTOR" have a picture of you above it?

I also owed chase bank who sent me to collections with creditors fin.and this was in 2008. i recevied many letters demanding payment and threating letters that i would be sent to court, i also started to get letters offering 40 to 50 percent off what i owed on that credit card, at that time i did not have that money either. In Sep 2010 i got a letter saying that if i did not contact them with some kind of payment it would be filed with the courts office which it was. I contacted creditors fin and i am now paying them 183.00 a month for 6 months to pay them off and they settled with me for more than half of what i owed them, i set up a bank acc soley for them to take that money out in case they decided to just take all my money.so far so good though SO FAR i have nothing bad to say.

I got a letter from Creditors Financial Group stating that I owe $3375 to Chase bank. However after checking my account balance and information everything seems to be normal. I have never received a notice from the bank stating that I need to pay a balance and I have never used a credit card. I havent event made a single transaction using my account in months! I will be sending them a letter asking for validation but is there anything else I should be doing?

    Fuentes,

Be sure you send a certified letter, with a return receipt. That way you have proof that they got your letter. Make a copy of the letter you send and keep it for your records.

If any of you are in a bad financial situation, DO NOT let any creditors drive you crazy. All you have to do is to send them a letter asking them to "cease and desist" all calls to your home or place of employment. They can, however, communicate with you by send you letters or legal notice. If you credit card company sent your bills to a debt collect, that means that the debt collection company purchased your account for much more than you owe them so try to negotiate if you can. If you don't have the means to pay them don't feel bad about filing for bankruptcy. It's your right to do so. If you're getting calls from debt collectors, your credit is already damaged so start fresh. There are some non-for profit organizations that can help you with your bankruptcy.
