Litigation Threat From “Adam Wins”

A couple days ago I received an email from Joel Hirschhorn, a Florida attorney representing Adam Meyer from AdamWins.com.

According to our users' posts Mr. Meyer cold calls the public promoting subscriptions to his winning bets on sporting events, and a number of consumers reported that they lost money when they placed bets as suggested.

The letter demanded that we "withdraw all posts, comments and information regarding Adam Meyer, adamwins.com and the telephone number (954) 472-0141, as well as publish a full and fair retraction, apology and correction in as conspicuous place and type as the original information was published and disseminated."

In my email to Mr. Hirschhorn I explained that 800notes.com is an “interactive website” where the content is supplied by the community, and hence it's not up to us to decide whether the content is defamatory. I then invited him and his client to post rebuttals in the discussion.  In fact, some  rebuttals had already been posted.

Finally I let him know that this is not the first time we have been threatened with litigation, and if he and his client decide to sue the website and its owner, we will fight back and will win.

His response was:  "I presume with your confident attitude you must have graduated at the bottom of your class from a third world law school."

At no point in our correspondence did I say that I am a lawyer. I am just someone who happens to have experience in this area of the law, thanks to this website and Paul Levy from the Public Citizen organization who has been very generous in sharing his knowledge over the years.

We are now waiting for a substantive response but I doubt there will be any.

    Is it just me, or does it seem odd to anyone else that when Adam Meyer wants to suppress a little free speech,  involving libel and communications law litigation,  his first thought is to call a criminal defense lawyer?

    Yet another bullying nitwit in a bumper crop this summer. These types all think our free speech rights and safe harbor provisions dissolve the moment they sense a threat to a fraudulent business model. The forum thread in question bears a history of complaints dating back over two years. Stepping in this late and throwing a hissy fit tells me all I need to know about Meyer.

    A lot of people get criminal and civil court confused. The kneejerkers who reflexively reach for the biggest hammer when they get angry are very prone to this confusion.

    Errrm, that's not a review, it's more like a caustic comparison ad hosted on the site of a competitor. An amusing observation if true, but hardly an objective review.

    Yeah!   A criminal defense lawyer who specializes in drug and white collar crime is at the top of Meyer's speed dial.     Is anybody surprised?  :)

    I've got to agree with Resident - this non-review is kind of like Burger King saying Hardee's hamburgers are lousy, but the ones at Burger King are great.  (hint: They're both lousy hamburgers.)
