- BigA replies to old but not stupid| 2 repliesWell that would not work as a defense on a couple of counts. First, the call was made to you, so whether she said your name or not, the attempt to collect the debt violated the FDCPA and various state laws. The second reason is that you would not be suing for "harassment". Everyone seems to think that is what you sue for but you are all wrong. That might be one count, but you would be suing using the FDCPA and any state collection laws that might be on the books.
- Old but not stupid replies to BigA| 1 replyIf this were a legitimate debt it would have been covered in a bankruptcy over 10 yrs ago. So the federal court would definitely consider it harassment. But since I don’t know who they are or who they are collecting for, I’ll just keep blocking them.
- BigA replies to Old but not stupidOnce again we have a failure to understand the law. Harassment is not a federal question of law. However, the FDCPA specifically states that it is illegal to attempt to collect a debt that is not owed. Also, Bankruptcy law specifically states that it is illegal to collect a debt that has been discharged. While we presently do not know where they are located, they will make a mistake and they will be found.
