- Deidra| 2 repliesI also have received messages from two consecutive days in a row from an Elliott Lockwood, a process server, stating he made an attempt to serve me with papers yesterday. I called the number 216-539-1591 last night and also received the message 401. When I called this morning I spoke with a gentleman he states these are not court papers but a letter of intent. I asked why do you have to serve a letter of intent? You can very easily do so by Certified Mail Registered Mail Returned Receipt. He stated he was an attorney, however, when I tried to find him within the Ohio Bar Association Registry his name is not listed. In all states you have to be registered with a Bar Number. I wonder if these individuals know it is illegal to state yourself an attorney. This is supposedly a law firm of Oak Barnes and Associates, however, the research I have completed this is not consistent with this specific law firm's phone number or practice.

- Robin replies to DeidraSame! No such company! And when I asked for an address they would not give me one! I said if you have something to give me than mail it! Same name! Please report to the federal trade commission
- Robin replies to DeidraJust made a phone call to the better business bureau regarding this coming that has an Ohio number. No such business listed anywhere in Ohio. I also just called the state police and gave them all of the information
- JGot a call today from same number. Saying it was directed at my brother, so they got that wrong. Same thing about going to be served papers for charges unless given a call back within one hour. Never picked up the phone or called back. Also was from a restricted number from a "Judy Lewis" call back number 216-539-1591. Said something about the "Filing Firm" (I think) but that was kind of garbled.

- DB| 1 replyI received a call from this number also. When I called back I talked to a Raymond Smith. They want me to pay $800.00 over the phone with a debit card or a prepaid debit card. They said it's for something from 2014 that's been charged off. I contacted my attorney and did a conference call and they said that they are going to forward all the info to my attorney. My attorney is going to find out what's going on.

- VBKHave received 2 calls from a "Jennifer Lee" stating the exact same thing as other people have. Down to the "good luck". Didn't call back but never saw anyone. In our county the sheriff's department serves papers and they sure don't call ahead.

- WNN| 1 replyGot a call the last couple of weeks and finally decided to call back today. When I asked where their office was he said South Carolina. I asked what it was about, they said a debt I owed (that I had paid off). I asked them to send me a letter of intent and the letterhead is a Buffalo NY address for a UPS Store. It's not even a letter of intent. The street name is misspelled and no phone number on the letterhead. How are they getting away with this and who are they? One wonders how many folks they have scammed. FYI folks - Please change your email passwords if you have not done so. They get information from your emails as I know mine started a couple of days after receiving a deep dark web alert for email break-in on my credit report.
- Caller: Oak, Barnes and Associates
- Eltee| 1 replyI received a call from an unknown number telling me they needed to know if I’d be home from 3-4 pm today to be served. But, they gave me a number of 888-651-4410 to call if I wouldn’t be home. I called that number and they said it was from a payday loan I didn’t pay back of $537.11. They said they were Oak Barnes and Associates. They had the last four of my SSN and my Bank name. When I looked up the number it said it’s a scam.

- Call type: Debt collector
- BigA replies to ElteeIt is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1
Also file a complaint with your State Attorney General's office.
