    I received a voicemail from phone number (323) 603-3975 stating her name as Ciara Fray and she was calling on behalf of Bensen & Associates. She proceeded to say there was a civil complaint against me out of San Bernardino county and I have not responded to the legal documents that were sent to my address. Which is not true. No such legal documents have been sent or filed. They went as far as giving me a case number and call back number of 888-713-3045 for Bensen & Associates and if they don’t hear from me legal proceedings will go on with or with out me. Good luck since there is no such case number filed with my county. It is definitely a scam.

    Caller called my unlisted cell phone and left a msg stating she was from Benson & Assosciates regarding a civil matter of which I have no knowledge of the names she mentioned and requested call back.  I believe this to be a scam and they should not be contacting my unlisted number.  They should be investigated for fraud.

    Alguien me llamo preguntando por mi hija y q era algo confidential y q no m podian dar informacion y me collarbone luego me llamaron por mi nombre pero era en ingles y les dije q no entendia y q me iban a llamar en español y colgue porke pense q era algun tipo de scam.... despues llamaro a mi tia preguntando por mi y q era algo legal y confidential y q tenian q hablar conmigo y todos en mi familia se asustaron ... y al poner el num aki encontre todos estos mensajes de q han llamado a mas personas por lo mismo.... yo no tengo ningun problem legal ni confidential... cuidado con estas llamadas

    I just received a phone call from 323-603-3975 stating they were calling from Benson & Assosciates regarding a civil matter against me , and i failed to fill out paper work  and now im being sued and i need to call 877-380-0287 , to continue with the case , and i need to deal with it today or else. I never received any papers , and the la county court wont have anyone call you if someone is sueing you , they will just show up and serve you. this is fraud , please be careful.

    I had caller say she was Liz and that they had an urgent message for my brother, but they used his actual name. (?!) I used my google Call Screen. They did not provide any more information. Just that it was urgent. Sounds like a scam.

    threatened suit about a 14 year old credit card debt, said they would take my 20 year old blown motor, dodge dakota, and garnish my wages. Been out of work for 2 years with Heart Failure, no income. Would settle debt for 40% of amount. Complete scum.

    Got a call from this number said I got legal
    action against me needed to call 866 #. hang up and called me 3x , it’s a scam. Mind you called my sister with a 702 area code. These people are scammers.

    I tried to tell my younger siblings that no legit legal action will ever call you, you will be served papers at your residence or place of employment. But they seem to question me?? Geesh...  Definite BIG SCAM.

    I told my family that no legit legal action against you will ever call you, you will be served papers at your residence or place of employment.  Definite BIG SCAM. If they get you to admit it's you or your debt, they an put it back on your credit report. Block the number

    I received a called this morning to my unlisted home number stating she was from Benson & Associates regarding a civil matter that my sister wasn’t aware of but she needed to speak to my sister but as soon as I told her my sister was working. The same lady asked for me with my full name of which I’m  still asking myself where do they get all this information. I believe this to be a scam and they should not be contacting my unlisted number.  They should be investigated for fraud. They give you a Returned   #866-516-0069

    The fake process server/location finder extortion attempt usually consists of the following:

    They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and must be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
