- Raven| 2 repliesTonight was the 1st time they called, and like someone else commented I didn't answer bc I didn't recognize the number....Get on your PC and check out the things debt collectors AREN'T ALLOWED BY LAW to do....One of them is if you tell them to not call you again, then they're, BY LAW, not allowed to...If they do, get a hold of an attorney who works w/this kind of law....Or join Prepaid Legal for $16/month....They've been a big help to me w/debt collectors aka liars, aka bullies, aka .....Oops, it wouldn't let me say...Lol~

Note § 805.
(c) CEASING COMMUNICATION. If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, [some exceptions then given]
Note the phrase "in writing". Simply telling or emailing the caller to stop calling is insufficient. - Suggestions replies to RavenHow about some of these other provisions of the FDCPA:
§ 806 Harassment or abuse. Do they ring your phone and hang up every time you answer? Do they call for someone else after you've told them repeatedly that they have the wrong number?
§ 807 False or misleading representations. Do they falsely claim that you owe a debt? Do they inflate the supposed amount of a debt and then offer a "discount" if you pay immediately? Do they threaten legal actions that they can't take? Do they use a caller id that falsely represents that they have a local office in Pennsylvania?
§ 809 Validation of debts. Have they properly informed you of your right to dispute the debt?
Or do they violate the TCPA by calling your cell phone with an automatic dialer?
Of course, all of this is premature until you answer the phone and find out what they want. You haven't even proven yet that they are trying to collect a debt from you. - AnnaCalled at 8 AM. Did not pick up, they leave no msg.
