Tele: (833)467-0091 (calling you), (833)467-0092 (if you been contacted by phone) and (833)628-0056 (if contacted by letter.) THIS COMPANY IS NOT LISTED AS A COMPANY DOING BUSINESS IN THE STATE OF NEW YORK. They stated: to me, they are a "Law Firm" representing Capitol One - 1st call: wants $610.00 (to be left alone. Told I had six days left till we are due in court ,that a Case/File - provided a number that the case will be finished for a larger amount of money. 2nd Call: Was told they are calling me to talk about settling: I ask them, their name and where are they located? I was yelled at and told THEY ARE A LAW FIRM! and in New York. I told them their phone numbers listed them somewhere in Virginia, this made him madder and he said OK, I was going to get it now - I will receive a summons in 4 days. These guys did not have any correct information on me so I was not going to provide any. Do not overthink the call simple ask 1.) who they are. 2. Where is their physical location or where the address is to where legal process can be served upon their business. 3. they "Full" name of the individual you are talking with. (WRITE EVERYTHING DOWN TO INCLUDE DATE AND TIME) DO NOT GIVE THESE PEOPLE ANY OF YOUR INFO THEY WILL ELECTRONICALLY TRACK AND SURVAILENCE YOU TO HERRASS AND INTIMIDATE YOU (AGAIN ILLEGAL.)
Interesting enough, is the fact of similar business's operations, close in address and name to this with complaints in the Better Business Bureau of western New York (Buffalo Area). 1.) Ross Wright and Group (Collections), 50 East Ave., STE: E (Physical?)/ PO BOX 385 (14095-0385), Lockport, NY 14094 2.) Jacobson (Jacobison) and Wright, 733 Delaware Road Ste 238,(UPS Store),Buffalo, NY 14223, 15.9 miles from Lockport, NY These are most liked purchased Boxes in other business's. But all are the same entity running the scam use a call center. Listen for the background noise of your caller for other conversations going on (call center that is being paid to make the calls) 0 this is a scam. - Michelle replies to Kevin| 2 repliesI got a letter from these outfits claiming i is money to capitol one. Jokes on them. Literally the only credit card I don't have not to mention i don't owe anyone any money at all. Again no physical address just a po box. This is awful should I report this to the police

He stated his name is Michael Stapleton with Oliver Wright & Associates. I asked for the physical address of the business. He replied, "No, we're not giving you that." and he hung up on me.

- BigAYou will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt, and we would all be the richer for it. They are not registered in any state, so they are not legally conducting business. They also would not be able to register as a debt collector in those states that require a DC to register. The only Oliver, Wright that I could find was a company in Georgia that was administratively dissolved in 2016.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
