- tlw04 replies to Anon| 3 repliesThey can still call after the 2 years, and they will. I still get calls about a $100 debt from 15 years ago (not mine, my ex’s)...the 2 years statute of limitations just means they can’t take you to court. The can (and will!) continue to call forever, as long as the debt remains unpaid.
- tlw04| 1 replyIt’s CBV collections calling. 9/10 they won’t leave a message. The reason is because by law they can only contact you so many times in a week (I can’t recall the exact # of times off the top of my head), but if they call and you don’t answer, if they don’t leave a msg, it doesn’t count as a contact. Leaving a voicemail, or speaking with you directly (obviously) counts as a contact. The majority of times, by the time they contact you, the debt they are trying to collect has already passed the statute of limitations for them to be able to take you to court to recover the debt. In Ontario it’s 2 years (it varies province to province). After it expires, as long as you don’t verbally acknowledge the debt, or make a payment, the debt cannot be enforced. If you do acknowledge it, or make a payment, it resets the 2 year clock. That being said, they will continue to call...over and over and over again...blocking the # won’t stop them, they have dozens of #’s they call from. The best way to stop it, is to 1 - pay the debt, or 2 - answer the phone when they call, ask why they’re calling, most importantly ***DO NOT ACKNOWLEDGE THE DEBT***, ask them for their mailing address, and let them know that you are disputing the debt, then send them a registered letter telling them that you dispute the debt (amount is wrong, you never purchased the service, etc) and suggest they take the matter to court. Plain and simple. Once you do this, (the letter must be registered), they are no longer legally allowed to contact you, and they definitely cannot take you to court as long as the statute of limitations has expired. That being said, there are a few debts that are exempt from the statute of limitations act - taxes, tickets or fines issued by a government agency, that sort of thing. You can easily look up what kind of debts are not covered by the statute of limitations, and as long as the debt your being harassed about is protected (chances are if it’s been sold to a collection agency it falls under the statute), sending the registered letter should stop the calls. If it doesn’t, they’re breaking the law, and you should file a complaint.

- ellie replies to tlw04If the item is removed from your credit report they should not be calling.
- LyndsayCalled me at 7am claiming to be "Telus" asks me to verify some information. I told them "absolutely not as I have not had a telus account in over a decade" and hung up the phone. Environment was very loud, called from a local number, and when she "transferred" me it seemed like she just passed the phone to the lady beside her. This is definitely not a legitimate business or even credit agency.
- Lyndsay replies to tlw04Thank you that was very helpful information in general, I get very confused with the 2 year crap. Ive been spending the last few years heavily monitoring my credit and building it back up. These people are trying bring back problems in my life from when I was 18 and had a $400 cell phone bill. Just let me live my life haha
- Skipster| 2 repliesReceive a call at home before work, (about 8 am) and hourly on my cell after that. If I owe anything, it's 20 years ago and long gone from my credit report.
Dunno if it's a coincidence, but the calls started the day after I got approved for vehicle financing. (bank financing through a new car dealer, not 20% through some place that sells your info) - Tygerkat replies to Skipster| 1 replyYes, it's most likely just a coincidence.
