    I don't have anything on these crooks right now but will dig into them.  In the meantime Arizona requires debt collectors to be licensed.  It seems they try to get default judgements against people so if you receive legal papers be sure to answer them in the time limit set by your local court.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  [/u][/i][/b]

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    Got a call from this law firm and a message was left stating:  "Hi this is Vanessa calling from David Hameroff Law. If you would please return my call at 520-792-3745 Extension 232. Thank you."
         This Vanessa spoke at worp speed & very hard to understand. This is someone who has practice speaking this introduction. The only lawyer that is lower than an insurance defense law firm [some firm that has only one clint and that is a State Farm Insurance type of firm] is a collection type of firm. If you are on social security, you are "judgement proof" as a collector can only chase a person who owes the feds taxes and/or child support. Your social security cannot be taken away from you except for only those two things. If they or when they file against you, go to the court house to gat a "stay" in the exparte order department of your courthouse where the law firm filed the collection case.  File the certifed copy of the stay, you must do that as soon as you are served the guarnishment action of your case.  Be careful, these crooks will not always serve you the lawsuit. If the lawsuit has no case number asigned by the court these crooks have not filed your case yet. They save money but trying to get you to be afraid and pay you off. Don't fall for it. They must file the case with the court to get the guarnishment of your checking account. DON'T LET THEM FOOL YOU!!!

    I can tell that you never went anywhere close to a law school or book.  Pretty much everything past "collection type of firm" is wrong.  Being on SS does not make you "judgement proof", as you can still be sued and therefore have a judgement against you, which may or may not (depending on state law) put a lien against any real property that you might own.  Collectors can chase anyone, not just people that owe taxes and child support.  Further, SS can be garnished for student loans and certain other types of court ordered payments.  Where did you come up with "gat a stay" and what is the "exparte order department"?  Once you are served with the garnishment order, well that means the case is over and you lost.  They need to do more than just file a case to get a garnishment order (wait, did I not just say that?).  Of course if you are able to cite a reliable, verifiable source for your information, then please do so as I would certainly like to read it.
