Recording stated it was not a telemarketer, but that (identified a name) needed to call # back, and reference 'account no xxxxx". Reverse White pages search identifies number as belonging to Southern Financial Services, a debt collection agency, in Hattiesburg, MS. IF this is a legitimate collector, we have several problems: no live person ever came on phone; caller never identified who they actually were; recording did not inquire if the party they were calling was even at this number, or home, or available. I believe this is a violation of the Fair Debt Collection Act ... and more probably a junk debt collector who has no real information, is attempting to collect a debt past the statute of limitations, and no legal or legitimate tie to the original creditor. - Beyond annoyedThis number has called my phone numerous times and does not leave a message. But will call repeatedly . I called them back once and they acted like I was their best friend callin me by my first name . They proceeded to tell me I owed money for some dr bill and when I asked for proof they told me they didn't have to provide me with any proof?!? Excuse me but unless you can provide me with some documentation then this could be any fool trying to get money from me. Please get a clue. I am not an idiot. You provide proof and If its valid then we will talk if not then take a hike. It's called harassment to keep calling!

They say they will take this no. Off calling list but in a few days they call back again sometimes with a different name.

If that is true, why did you search for their phone number on a phone complaints site?
Also, if they are a "debt collector" how do you know you owe THEM money? Any debt you incurred would have been from the original lender. Is the "debt collector's" name really shown in your credit report, or is it the name of the original lender?
And, finally, did they send you a Validation of Debt letter, as required by law? - GateKeeper replies to BobbiThat doesn't make them legit. They are only legit if they follow the law.
Otherwise they are criminal extortionists.
All debt collectors are required by law to send you a DEBT VALIDATION. This is sent through the USPS ONLY (email, text, faxes, carrier pigeons, smoke signals...none of those count) and state when you incurred the debt, to whom you owe the original debt, and how to proceed should you not recognize the amount.
This must be sent within 5 days of the first time the company attempts to contact you.
REAL DEBT COLLECTORS SEND THIS. Scammers do not.
A few other things to know-
-You cannot be arrested for ordinary debt in the United States.
-Process servers do not call in advance. They only get paid if they deliver you papers the court (not a private company) has ordered be delivered, and if you flee, they don't get paid. Therefore, they do not call ahead of their arrival.
-Likewise, officers do not call you to tell you they will be arresting you. Why would they?

***A company must be licensed in their state as well as the one they are trying to collect in if two different states are involved.
Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
