- DJD| 8 repliesPortfolio Recovery and Encore, both collection agencies, can no longer file suits until they provide consumers with information about the debt, such as the name of the creditor and the charge-off balance and offer consumers access to original documents relating to the account. CFPB director Richard Cordray said in September 2015. No more lawsuits forget these people.
- Caller: Portfolio

- BigA replies to DJD| 6 repliesThat agreement does not preclude them from filing a lawsuit, it only restricts them on what they have to do first. Telling people to forget them is extremely poor advice. What people should do is to assert their rights under the FDCPA. Perhaps you should actually know what you are talking about before saying anything? After all:
Mark Twain
“It is better to keep your mouth shut and appear stupid than to open it and remove all doubt.” - DJD replies to BigA| 4 repliesThey have to give evidence before they file a suit. That restricts their actions.
Sounds to me like you are working for Portfolio. Probably an attorney that they hire. Or inhouse attorney. - BigA replies to DJD| 3 repliesToo bad you failed reading comprehension. "That restricts their actions." Which is pretty much what I said, it restricts their action but does not eliminate it. They can still sue. Further, I said this "What people should do is to assert their rights under the FDCPA." which I doubt someone from Portfolio would say. But then you are obviously too stupid to comprehend that as well.
- DJD replies to BigA| 1 replyMost of your response is to discredit me. This only makes you look bad. We both agree they have to submit evidence before filing a suit.
- TOI. Tired Of It replies to LeeThe quick response is to ask you to google it! I did and found good, and shocking information about it, but left feeling very disappointed. They have lost a few class action lawsuits, and because they make so much money scamming people by collecting on expired debts, it hasn't done anything to stop them!
- TOI replies to BunyaThey have both of my numbers too and do the same thing. I'm getting rid of my land line and I'm going to change the cell phone number. You should google the class action lawsuits against them. They've lost several, and were even ordered to change their illegal collection practices, but they make too much money on all of those people that they frighten into giving them money.
