I also keep getting phone calls from these people, stating I owe them money for a payday loan I don't remember taking out.
They won't tell me what company it is, but that I will be sued for bank fraud, and check fraud if i don't pay them.  Is this a fraud?

I just got a call from this company a few hours ago. The guy had a strong Indian accent and said his name was Justin Smith. They claimed there was a case being filed on me on Monday for bank fraud and some other things for payday loan I never paid. He said the amount owed was like over 10K. The state I live only allows payday loans up to a max of $500 and max collection fees allowed are $15 for an NSF. The scary thing was the amount of info he had on me. I kept asking for the date I rec'd the payday loan and he kept saying to look at my contract. I have never taken out a payday loan online.

I've recieved three calls from this number in the past two days. Both days similar messages were left in my voicemail stating that "Justin Smith" needed me or my detained lawyer to contact him asap and if I don't then all he can do is wish me good luck.".

The incoming number all three times was 523-122-93 - a spoofed phone number. The callback number given in the message is 646-313-3791 which seems to just forward itself to some other number.

I called back today and confronted "Justin Smith" about his fraudulent activities. He claimed that he was working as a legal aid for a law firm entitled "legal accounts association". I informed him that I've attempted to look up that company name and it is non-existant. He assured me it did exist and needed to speak to my son immediately (I initally informed him I was the father of the person he was attempting to contact). I then asked him for the mailing address of his company and he informed me he was not able to give out that information. I asked him his name again and he responded "Justin Smith", I then inquired if he ever goes by the names Rick Brown, Kevin White or Adrian. He avoided the question and again insisted I give my son his contact number asap. I asked why he needed to speak to my son and he then informed me that my son had applied for a payday loan of $10,000 and he was calling to inform my son that he was approved and they were going to in-fact give him much more than the inital 10k that was asked for. I again made the point that I was 100% sure this was fraudulent activity and I was going to be reporting him to the appropriate legal authority. He then informed me that because I was accusing him of fraud he was going to cancel my "sons" loan application and that my son would never see any of the money. I argued with him for a few more minutes until he finally got tired and eventually said he no longer wanted to talk to me and hung up.

This is a fraudulent call. Please do not give them any type of personal information. There really is no way to stop the calls as they are spoofing their phone number. Your best bet is to just not answer or return the call so that they just give up.

All I can say is do not answer the calls.  They will start coming from 310-388-1881 or they will give yout his number to call back.  If you google that number on line you will find a lot of this same information as well as advising you to contact the FTC and report them.  Which I have done.  THere is also an article on there from Kansas advising people to beware.  Read through it.  I have been getting these calls for over a week now.  I spoke to them twice and now I don't answer.  THey call my work and my cell.  They have a lot of personal information on me.  However the address they provide was an address I didn't live at until after the date they say I took out this loan...which I never did.  The article also gives you the criteria for debt collectors and they are violating every one of them.  It is all fraud.  Don't give them any information.

I received a call from these people today.  The number that came through on caller ID was 052-312-293.  Message was left by Allen Smith stating a case had been filed against me and that I or my attorney needed to call back ASAP and if he didn't hear from me he wished me good luck.  They called my work number too.  Wanted me to call back at 646-313-3791.  I had this happen a few months ago, boths times being people with Indian accent.  They almost got me the last time, but I was smart and called a laywer for advice and the local police department.  They told me a collection agency cannot harass you at work and they have to send proof of the debt in writing...and they cannot take you to jail!  So when they called this time, I called them back and asked for Allen Smith.  He wasn't available so I talked to a Mark Thompson...pretty sure Mark and Allen are the same guy cause they sounded exactly alike.  I asked him the date of when I took out the loan I was being told I never paid.  He said sometime before August 15, 2009.  ???  You can't tell me actual date??  Then I asked him who the creditor was and he stated he couldn't tell me. ??? Why?  Then I asked him to send me something in writing validating that I owed this money...again he couldn't release that information.  He then asked me to verify the last four digits of my social and I told him I couldn't release that information.  LOL!  I then told him under the Federal Fair Debt Collection Act he could not call me at home or work until I received something in writing that I really owed this debt.  He then told me that I didn't need to speak the law to him cause he knows the law very well.  I said good then if you know the law so well then I won't be receiving any calls from you again until I have something in writing.  He then told me he was filing a case against me and I would spend up to 60 days in jail.  Then he hung up on me.  They said this months ago too and a cop never showed up at my house or workplace to take me to jail.  Stupid freaking jerks!  Get your own jobs and stop stealing our money!  DO NOT GIVE THEM ANY INFORMATION.  TELL THEM UNDER THE FEDERAL FAIR DEBT COLLECTION ACT THEY CANNOT CONTACT YOU ANYMORE!

Consumer Alert: Attorney General warns Kansans of debt collection scam

January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers.   Consumers are warned to not submit payments to these fraudulent debt collectors.

When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid.  Consumers state they have never obtained such a loan or paid off the loan years ago.  The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names.  It appears the phone numbers used by the scammers are “spoofed” numbers, so that the number appearing on a consumer’s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.

When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent.  These scammers have been able to provide consumers with identifying information, such as the consumer’s social security number, home address, e-mail address, names of family members and the consumer’s computer IP address.  Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.

If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court.  Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union.  The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as “We’re filing an affidavit against you” or by stating a lawsuit has been or is in the process of being filed against the consumer.

A hallmark of each scam has been calling consumers repeatedly at their place of employment.  This scam hit home when an employee of the Kansas Attorney General’s Office was repeatedly called both on her cell phone and at work.  Despite the employee’s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an “officer”.

“I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ‘If that’s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming’,” stated the employee.

“It is important for consumers to know their rights under the law,” Attorney General Six said. “If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.”

Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact.  The notification should contain  information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer’s arrest, or using the threat of violence.

More information is available on the Federal Fair Debt Collection Practices Act at http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf.

You have no need to worry.  No court would rule against you since the payday loan ripoff company knowingly accepted a bad check.

I received a call from this number and he left me a message stating his name was Kevin. Told me that I needed to call back and wished me luck if I did not return his call. Told me that charges were being filed againist me for payday loan fraud. I took out a loan and never paid him back. He said that I could fight the charges but it would cost me over $7,000. I ask him for the name of the company that I took this loan from. He told me a name that I never heard of. The scary part is that had all my information: name, DOB, SS, and banking information. He said he would be willing to settle for $700.00 and would confirm with his attorneys I hung the phone up.

Hello, I'm in Seattle and just recently a Justin Smith called my job saying I needed to send money for a payday loan I don't remember getting. They keep calling my cellphone and it drove me nuts at work for a week. They gave this number 1-646-626-4200 and fax# 1-949-242-3035. They keep calling and telling me to get an attorney and send the money for the documents. I haven't done anything to help them.  It's funny how this lady comes on the phone saying shes an attorney but tells me to shut up and listen, her phone number is 818-746-3844 from Canoga Park,CA.  I called the state attorney generals office and they said they cant do anything about the harassment. The only thing I'm getting out of this is a bad headache and unfocused at work. Can somebody STOP them.
