My sister received a call from this company and they told her that they were getting ready to file criminal charges against me for a payday loan check fraud (statute of limitations runs this year).  When I called they told me they were NOT a debt collector but a "legal processing" firm and the did summones and restitution.  My guess is they are a debt collector - someone who bought this old debt and is trying to scare people into paying.  My debts were discharged in bankruptcy last year.  I contacted the payday loan companies and they are NOT filing any charges.  THEY are the only ones that can.  When I pressed the woman for more information like just exactly WHO was the company filing charges and asked for their address she became very argumentative and belligerent and hung up on me.  I didn't play their game.  One of the payday loan companies, Advance America even has an alert on their website about these types of scams.  When I Googled the number it came up as a cell & when I Googled the company name nothing came up.  I don't know why they contacted my sister.  If they found her they could find me.  Beware of these scams.  They cannot threaten criminal action.

My young adult son received a call from JW Marshall who claims to be an attorney for Benson Fuller Associates.  They have no internet page or listing other than 1 complaint through GA BBB and those on this website.  My son was told he has about 3-4 hours to pay $700 or a felony warrant will be issued for his arrest.  An old (paid off payday loan) was cited.  My son contacted the state's attorney general's office and several people there told him this is a scam and that no one other than the original loan company can file for an arrrest warrant.  Another call from JW Marshall and Chris Johns of Benson Fuller indicated that my son was actually on the docket in court today for writing a bad check in excess of $500 (my son has NEVER written a check in his life!) and for malicious intent to defraud the loan company.  They alleged he had written a check and closed his account prior to the check clearing.  Interestingly, that account for my son is still open!!!  My partner contacted Mr. Marshall, who initially was rather pleasant; insisted they are legal processors and NOT a collection agency (although the BBB has them listed as such), and that he, Mr. Marshall, is an attorney (I have not checked that fact as it doesn't deserve at more of my attention).  When my partner started explaining that the loan in question was paid in 2009, and saying that he has seen various internet complaints against Benson Fuller, Mr. Marshall became very defensive and then hung up the phone.  Apparently those dealing in fraud and scams don't like to be challenged.  RUN do NOT walk from this company.  They should be thrown in jail.
