Some Payday Loan lenders will attempt to convince the borrower that the check they left is fraudulent, and the lender will file a fraud case. Borrowers should read this:

The important paragraph in that PDF is:
"... if the small lender knew, at time of receipt, that the account had insufficient funds, or that the check was postdated, the issuer has not committed the crime of Check Deception"
(Although that is a citation from Indiana law, the laws are similar in most states that permit payday loans)
Here is a citation from the Uniform Commercial Code (UCC), which is valid in ALL 50 states:
Section 3-104(2)(b) of the UCC, defines a check as “a draft drawn on a bank and payable on demand.” A postdated check, since it is not payable on demand, does not satisfy this demand. Consequently, it has generally been held by most states that the giving of a post-dated check does not constitute a present fraud nor is it within the scope of the bad check laws.
Yes, borrowers should pay their debts, but lenders must (by law) follow the correct procedures to collect those debts. A summary of the Fair Debt Collection Practices Act (FDCPA) is here:

Some things are beyond our control and, although, we have have good intentions, just aren't possible at the moment. I held my account in perfect status for over a year and a half, until a chain of UNEXPECTED events, completely OUT OF MY CONTROL, can't tumbling upon me. I have given these people my information to take 5 TIMES the amount I actually owe. They didn't charge my card. That's not my problem. They had their opportunity. They passed on it so that they could keep harassing and scare people into paying the full amount owed at once. If you aren't here to help the forum, you're part of the problem. Please excuse yourself from the discussion.

And a few more things;
- Companies cannot issue arrest warrants. Only those in the judicial system can issue warrants. They need to be petitioned by attorneys, and signed by a judge.
-You cannot be arrested for ordinary debt in the United States and Canada. There are no debtors prisons here.
-If there were ACTUALLY an arrest warrant with your name on it, your local courthouse would have it. Look up the number independently, and call them. I'm willing to bet there is no arrest warrant for you
-IF THERE WERE, however, no one will EVER call you to tell you they are coming to arrest you, or serve you papers. Process servers only get paid if they deliver your paperwork, and if you hide, they won't get paid, so, they won't tell you they're coming.
-Threats of arrest and putting holds on SSN's and other things like that are common scare tactics used by "debt collectors" who are trying to collect on a debt they cannot legally collect on. If they COULD legally collect on the debt, they wouldn't have to resort to scare tactics.
-REAL debt collectors will send you (because they are required to, by law) a 'DEBT VALIDATION'. This is sent through the mail (USPS) with a stamp on it (e-mail, fax, texts, carrier pigeon, smoke signals...none of those count) and tell you when you incurred the debt, to whom you owe the original debt, and how to proceed if you don't think you owe the amount, or if your records reflect a different amount. Remember, this is REQUIRED BY LAW to be sent to you within 5 days from initial contact (on the company behalf)

The truth of the matter is that it's you that is the only one in any "position" here. You're a fraudulent debt collector working for bogus outfit who doesn't hold any valid title to any valid debt. You can only rely on empty threats & your ability as a liar to try & extract money from your targets. Furthermore---people are being harassed for debts they do not owe, belong to someone else, were discharged in bankruptcy, have been paid or the SOL has expired.

Strongly suggest you try reading my previous post, as well as those from other registered 800notes users, for understanding.
If you really sent them $500 to avoid being served a warrant, you were definitely scammed.

They told me I had to pay before close of business today or there will be an arrest warrant for my arrest. I always Google everything and after seeing these post I will make my payment to the clerk of court and if they are legit which it doesn't sound like they are they can collect from them.
