Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

- BigAIn addition to the information that has already been posted and can be used to accomplish the following:
You will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt, and we would all be the richer for it. I don’t advertise who they reach initially if and when I receive these types of calls as I want to see if they comply with their disclosure requirements (they don’t fully comply but do use a generic recording before a live person comes on the line which is how I knew the general purpose of the call). I was equal parts amused and interested to hear what debt the US Air Force Jag Corps owed a two bit collection agency dealing in DOA, paper only debt (debt that’s beyond the statute of limitations for collection, as many of these are; they prey on citizens’ fear and ignorance of the law and their rights regarding such debts). Of course the male caller spoke of someone not in the office and no one I’d ever heard of much less knew. I asked if he knew who he’d reached or if he’d listened to the beginning of the call before picking up the line and he claimed he did. I replied by disputing that he’d actually heard that he called an active duty Air Force base and was speaking with a military judge, to discuss an alleged debt purportedly owed by an unknown third party. He fumbled a bit and I asked if he usually calls random government employees to ask about strangers’ debts or if today was just my lucky day. I then reminded him of his numerous obligations and failures under the federal (and state) fair debt collection practices act and informed him he needed to remediate his errors or cease attempts at collection. Finally I stated that under no circumstances was he ever to contact me personally or this number professionally ever again.
