- Chris| 2 repliesI just received a call from an employee of Albright Clark & Associates and they scammed me into paying $50 for a debt that i had years ago!!! they said that the interest was never paid, so i paid them in full and asked them to send me a receipt for my records. A couple of hours passed and i didn't receive anything regarding this payment so i decided to call back and nobody knew who i had spoken to, Emma Peterson. Then they were saying that i owed them $1880.00 for these accounts i paid for years ago. Scam!!!! the number i got a call from is 831-216-1169 based out Felton, CA

- WolfmanJack replies to Chris| 1 replySorry to be blunt, but you are now on their easy marks list and they will try again and again, and they will also sell your information to other criminals. This is why it is so very, very important to make them follow the letter of the law.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
If and when that happens this is what must be done:
You need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.

This is happening to me but I am getting more wise and I am getting less calls. Matter of fact, I used to get threatening voice messages but now when they call; they don't even leave me a message. I call the number back and I get firm with them in a nice way and it has backed them off of me. However, they sell my info to someone else hoping I will eventually give in. I have caught on to their game and when I read your post, you hit it on the nail.

I advised them that per FDCPA, they must send something and their response was, "we legally, don't have to." and that they have legal reasons not to. Not once did they recite the mini-Miranda that all collection companies have to say. They informed me in order for them to send one I would have to pay them first. Talked to 3 reps and not one recited the collection Miranda. All 3 reps refused to send something in writing.

Hmmm, if you're collecting on a debt wouldn't any form of payment be suffice? Rep states they would advise their client, that it would be best to take me to court where I would pay triple of what I owe. Sounds like a scam!

Or, for that matter, any of the regulars here. We dearly love to entertain fools. For some inexplicable reason our invitations are rarely accepted. When they are, our guests never come back to visit again. Perhaps we have bad breath? Maybe we come across as rude. I just don't understand it...
There are many of us here that would be more than happy to bring this crew up to date on the current state & federal regulations regarding the lawful collection of debt. Shoot, some of us can recite most of those regulations in a semi-comatose state. I should know! (Yuk-Yuk!) We'll be willing to help this outfit with their compliance problems free of charge. Somehow...I don't think they'll be accepting the offer.

Gunnar - William replies to AC| 3 repliesThe real reason they won't give an address is because they don't want law enforcement to easily find them. That's also the reason they won't go to court; they can't sue without giving their court - and the defendant - their business information.

They can't do that because they're basically bi-pedal, twice used trash bags walking around with the expected stench & lacking the funds to bail themselves out of jail for public urination.
Such is life in the "fast lane" of bogus debt collectors.

Next time they call I will give them the number to the CA attorney general and tell them that's my best contact number!

Gunnar - JannFrankesThey call from spoofed numbers so they appear to come from your local area. PLEASE PLEASE file a complaint with the Miami Attorney General. I have. The lady I talked to said they have an office in Miami, but have 48 remote locations in the US. This is a debt collection scam. When they threatened me with legal action, I asked the woman to deliver the papers herself.
Tell them you have opened a complaint with the FTC and the Attorney General, and that under federal law they have to send you a written letter telling you what the debt is, the amount, and who the original creditor is.- Caller: Albright Clark and Associates

- SarahThis company calls me also stating they're from Albright Clark & Associates, they've called with a local AZ# 602-640-0530, as a matter of fact literally just called again, stating I need to call them back to settle an allegation and to call 866-318-5139, they've also given 866-210-7385, 860-209-9276 and to use a file ID#77154. Saying I owe on a payday loan and they can help me resolve this. I'm literally shaking these people make me so mad, they're harassing me daily, they're calling my family harassing them daily. I've put a complaint into my county attorney, FBI, FTC, anything I can think of. This has got to stop!

These scum bags even when confronted with the fact that CA Statute of Limitations on VALID debts is FOUR years and they couldn't collect on the debt even if they wanted to, wouldn't give up. So the dumb [***] call me and leave a message saying this is their FINAL notice to me to call them back to settle this and I kept the voicemail....So I wrote a nice little letter to my District Attorney, Attorney General's Office, District Attorney's Office, cc'd the Department of Homeland Security and the FBI, CIA and Federal Trade Commission. If these low life, bottom feeding scum sucking prick bags think I'm scared of them I say bring it on I love a challenge, but when you threaten me, my family, my environment cause you are lazy uneducated pilfering thieving and manipulative POS bring your lunch darling cause the misery you have caused me is immeasurable to what I am about to deliver to your world. Next time you want to threaten people, you should probably verify their jobs/skillsets first before you go quoting "law" you know NOTHING about....GAME ON douches

You do need to alert your manager and HR Dept that you're being harassed by known criminals - your employer should be able to get their telecom provider to block the number(s) they're calling from. Dealing with financial trouble is stressful enough. But when a debt collector is hounding you using unscrupulous methods, it can make matters even worse.
The fact is, you have some rights when it comes to dealing with debt collection agencies. They’re spelled out in the Fair Debt Collection Practices Act (FDCPA), which protects consumers from abusive, harassing or unfair debt collection practices, and is enforced by the FTC. Under the FDCPA, debt collectors are not permitted to:
call you before 8 a.m. or after 9 p.m.
contact you at work if you’ve told them verbally or in writing that your employer doesn’t allow you to get such calls in the workplace
contact a third party about you for any reason other than getting your contact information; simply put, they may not tell anyone that you owe money
