- C.L.| 5 repliesCalled leaving a message with call back 877-289-2808 telling me i had important documents that were to be delivered to me and i needed to verify my address that this is a very important matter which needs my attention - called and they tried to tell me i owe on a cc from household bank - only thing is jokes on them ive never in my life had a cc with household bank too bad! And they would never identify who they were calling on bahalf of just said i would be served papers.....Bring it on!

A woman answered claiming to be Kathy Davis. Would not identify the company name. She told me I was being sued for A CC card from 16 yrs. ago, which I had no knowledge of.. She gave me 714 408-4663. Said it was her cell phone.

When I called back the guy was really rude and actually hung up on me. Saying that I owed money on a card that I took out in 07 from some bank I never heard of. They also said that they are taking me to court and they would not send me any paperwork on what and why I owe. Scam

- RussReceived several calls from this number about an account that I never had. They have threatened to come after my house and my vehicles, they have called previous people I have worked with and they threatened to put out and arrest warrant for me if I did not settle this debt with them.

They are probably trying to collect on a very old debt that legally the original company cannot because of age and the fact that they probably sold it to another company to try and collect. Also if the person calling really is from a delivery service, they would ask you to contact that service directly, NOT the company supposedly trying to serve you.
If you do contact them and verify information and debt, that restarts the debt timeline and they can now actually pursue you.

Now I'm not sure what you mean by "legally" since it is legal to try to collect debt past the Statute of Limitations in 47 states as long as they don't file a lawsuit or threaten to file a lawsuit. Nope, nope, nope, nope. The only thing that can reset the SOL would be if you paid them or entered into a new contract to pay the debt. They often call people that have never even been associated with you because they get erroneous information off of the internet.
The fake process server/location specialist scam usually contains:
They mention that they have received a Fax document or that some sort of complaint has “come across my desk” and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and have to be served within a certain amount of time. Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.

(Very long, but I wanted to give as much detail as I have...)
A message was left on my husband's phone last Tuesday, 5/13, from phone no. 714-408-4663, stating (female voice) that "this message is for (MY full name, including my maiden name), if you could have her please return the call, this message is regarding the property on (just my current street name -no house number, city, or state). We have a delivery that was marked as a failed attempt, we need to reschedule. Please have Ms. (my first name) return the call at 888-588-0120. I need to confirm or correct location information for the address on (just my street name again). The reference number is 182xxxx. Thank you". Didn't give her name, or a company name. But, like an idiot, I returned the call because I thought it was an item I had ordered that was about a week past due in being delivered (perfect timing on their part!). I PROMISE that otherwise, I am very smart, very suspicious, and very cautious when it comes to things like this, lol. I'M usually the one who says, "I can't believe you fell for that!!"
I called the 888 number last Friday, 5/16. The person who answered the phone identified herself as "Kathy (Cathy)" and she had called about a failed attempt to deliver advanced notice/legal documents -the mention of "legal documents" is what made me immediately suspicious, but I chose to hear her out, to see where it would lead.
She verified my address as (my full address), twice. I didn’t offer that part of the address she recited was incomplete. She also mentioned an address that we moved from in 2015. She said it was for an account that was "charged off" but had been transferred to collections (yet another piece of BS), for a “purchase from (jewelry store)" that I had had an account with. I told her that I haven’t had that account in over 10 years.
She then said they were a "mediation firm", and the debt amount, because of interest and penalties was now $2,XXX.06 (which is **5 TIMES MORE** than the amount owed when it was charged off!). BUT she said she could offer to reduce that by $1,000. She said that I could make payments, OR they could “offer settlement” down to $1,200, if I paid that in full that day. She then asked if I had a credit card to put it on! I told her absolutely not, that I no longer had any credit cards. She replied, "smart girl...".
She also said I have the option of "going to court" or that she could send me a “letter of compromise” in order to make payments instead -$500 down, $250/month for 3 months (=$1,250); another amount for 6 months that equaled the original amount, "reduced by $1,000; or she could offer “out of court”, no interest", an amount for 12 months that equaled the original amount, "reduced by $1,000". She said she would have to send me a "financial statement" to fill out to "justify" me paying the reduced amount and making payments (HA!). (LOTs of payment options, and several mentions of "court".)
That statute of limitations in my state is 3 years for this type of debt. However, I may have "re-aged" the debt by calling her back, not knowing any better, and basically acknowledging that it was a debt that I had had. But I had enough sense not to offer to pay anything or acknowledge any of the payment options. I told her I would have to "look at my options and get back to her".
She said her name was Kathy (Cathy) Davis and her call-back number is 714-408-4663. Upon further research, I have found that this same "person" and phone number has been mentioned in other places as a scam, as far back as 2018, to collect "zombie debt". There have also been calls from this number with variations on the theme.
Obviously, I haven't and will not call her back. And she hasn't called me or my husband again. I just wanted to share so that if anyone else gets a call from Ms. "Kathy", they'll know what's up.
