100% fake, phony, fraudulent calls. reported calls to www.ic3.gov as well as DOJ tips line. they're calling my maiden name for fake debt and for a fake payday loan FROM 2011!!! while payday loans are illegal in NY State but threatening to sue. yea good luck with that, as that's like a mobster suing for nonpayments of shakedowns, extortion. they won't/cannot provide any documentation, but are Googling family info AND calling family members, including elderly family members who were shocked at threatening call -- have me call or face prosecution. their intent: pay scammers over phone.
but it gets worse, they're operating out of Florida/Caribbean and using a P.O. Box while claiming to be a mediation service. they can't provide any legitimate info about their business, but keep using a scare tactic: if you don't pay us, we have to tell our client you won't pay. I'm like TELL YOUR FAKE CLIENT, hell, I'll tell them for you, if they actually existed.
we've been receiving these scam calls for years, every time it's a different company and amount. geesh, 85 payday loans if we added up all the calls. I'd be a millionaire given all the amounts they're claiming to have fake funded.
the calls stopped after 2013 but this is the first one since we worked directly with an Atty Gen in 2015 to locate the fraudsters to a beauty and barber shop in Las Vegas. they've consistently threatened to come to job, home, etc. and my husband (a retired cop and our direct neighbors are also cops) is like come on over (for arrest). but no documentation ever arrives, obviously because the calls are 100% fake. only mystery is how they've obtained personal information which we don't verify but are shocked that they're asking it so boldly.
the names are Miss King, Bethany Thompson, Holly, Jessica Riley and some pompous jerk named Steve. they're all frauds and their calls are auto recorded now and forwarded to law enforcement. I'd share the recorded calls but persons are relaying personal info with attempt to scare into paying scammers. it's more important to match their voices to other criminals in law enforcement database.
if you're called, do as I did: notify law enforcement. there is no debt, nor even a legitimate company esp. given wrong name persons are calling for and their refusal to provide anything but threats and extortion.- Caller: callerID 716-328-0785

- BigA replies to KacieNo they are not "suing" you. What they are doing is trying to scare you into paying them (extortion).
Criminals are masquerading as debt collectors in an attempt to extort money from people by scaring them into believing that:
a. You are going to be sued and it will cost you lots of money when they allegedly “win” their case.
b. That they are about to file criminal charges or that you will be criminally charged (they use the bad check or hot check claim a lot) and go to jail, even though debt is civil not criminal, there are no criminal charges, and debtor’s prison was outlawed over 200 years ago.
c. That they will take away your driver’s license.
d. That will garnish your wages without actually being suing you, going to court, or even winning a case and obtaining a judgement followed by a judge’s consent to the garnishment. They also claim that your wages will be garnished in amounts far above all legal limits.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.
