- DesaraeA man named John Stinson called attempting to collect a debt. He was nice at first then became very rude when I explained I have no job and no money. When I asked to speak with the manager he told me to call back in an hour. I called back in an hour and he told me his manager approved a cheaper pay off payment. Which was not the reason I called back. I called to speak with manager he then told me to call back in a couple hours. I ask him what the mangers name is he said Alex Judge. And he said he worked for Oracle Finance.

- Margaret| 1 replyI had a person call my work, his name is John Stinson. He has left messages for me and then he even pressed 0 to get an operator in which he told them it was an emergency and to have me paged. He made it sound like he was a family member so they had me paged while I was in a meeting and I took his call. He is very nice at first, tries to laugh with you and then says he is calling on a claim from Advanced America that is 4 years old. He says the statue of limitations is running out so he would like to get this settled. He claims I owe $1,500 and then says he will offer me a great settlement. After I tell him that I did not take any loan out with Advanced America and I would like documentation to be mailed to me, he then becomes angry, rude and frustrated. He then says that they are a paperless company (LOL!) and they only correspond by phone and email. I told him again that I would need documentation to give to my attorney so he can look it over. I then ask to speak to his manager as I told him that he must remove my work number and not call me at this number. He becomes very rude and I finally tell him to mail me documentation so I can follow up and then he hangs up on me.

If the Statute of Limitations is running out, that is his problem, not yours, as he will not be able to legally sue you or threaten to sue you after that. They are required by law to provide documentation. If he won't mail it, let him send it by email and let us know what it says. Do not under any circumstance sign anything.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
