In this land of high unemployment, rampant drug use and the reputation of having the MOST debt collectors per capita, anyone who can fog a mirror can get a job collecting debts. That means collectors (good & bad) can get fired from one job, then get rehired by another agency almost immediately.

Weinstein can afford to allow his 'goons' break the law because the pool for new hires is large and the penalty for getting caught is low (it's only money!).

Owner Bruce J. Weinstein certainly knows his share of those 'bad apples' after all, Bruce learned first-hand what happens when you commit a felony and get convicted when his banking career was cut short. Now he is determined to re-establish himself as a success in the collection business of Buffalo, NY as a DEBT COLLECTOR.

I have caller ID....am signed up on "Do Not Call" list...do not have any outstanding dept but still am annoyed with these interuptions. I do not answer to 1-716-995-7420.

This number has called my cell phone 12 times in the last 3 hours. When I call the number back I get a fast busy signal or messages that say "the call cannot be completed as dialed hang up and try again", "the number you are calling is not in service". There is never a voicemail. I am at work and cannot answer my cell phone. This is very frustrating. I am being harassed by an unknown number!

It's a Sunday morning, one of my only days off and the one day a week I can sleep in. This company has called me 3 times this morning! Not only are they calling me at very early hours, but they are calling for someone who doesn't even live here! I've told them numerous times that this is a new listing, the person they are calling doesn't live here, I don't know the person they are trying to reach, etc... They can't seem to figure out how to take my number off their call list. I have been a debt collector in the past. I know they can put the number on a do not call list. What the F*CK!!!

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

I received one call at 10 pm and another the next morning at 10 am asking for "Ann Wheeler".  When I insisted they had the wrong number she asked "you dont know her at all?" and I insisted that I didnt.  The first call they also asked for a male with a different last name.
