Unless you can legally record a conversation, refuse to discuss anything with them on the telephone. Inform them they must (per FCRA law) must send you written notification of the debt in question. Once notification is received, send another letter asking for FULL details as to exactly what the debt is owed for. For example, I have a local hospital doctor's group (which is made up multiple units) without details, there is no way I can determine who the original debt (or group) I supposedly owe money to. The collection agency MUST adhere to your request for detailed information. Most importantly, get EVERYTHING in writing, do not discuss anything verbally with these deadbeats. If they continue to harass you without the detail you require, you can possibly seek financial compensation in a court of law. Also, seek out the statue of limitations for your state. - BigA replies to The Guess WhoEveryone can legally record a conversation. In two party states they must inform the other party that the call is being recorded. The Fair Credit Reporting Act (FCRA) has absolutely not one single thing to do with debt collection. It covers (surprise!) credit reporting to credit bureaus to make sure that the reports are correct and fair! You do not have to demand a dunning or "g" letter since the actual law that covers debt collection (Fair Debt Collection Practices Act or FDCPA) actually requires them to send it within 5 days of first contact. You would then send them a debt validation request where they would then have to go back to the original creditor to get the information. Once they receive that letter (which should be sent by certified, return receipt mail) they must stop all collection activity until they provide that validation letter. There is no "statue of limitations". There is a "Statute of Limitations" which is an actual law.
Try actually reading and learning before giving advice that is basically wrong and misleading people.

Going through Identity theft. When, not given all the facts & my questions are not answered, you will not receive a cent from me! This company is extremely rude & will not give all the facts. Treat me rude & I promise you, you will get hung up on & reported!!

You will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt, and we would all be the richer for it. It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
