- Allen T| 4 repliesI must admit at first it seems kind of sketchy they said they were going to sue for an unpaid ace payday loan.At first I wasnt going to pay but he gave me a smaller amount to pay and saved me about $800 dollars also to tell you the truth i really took out the loan. If they are a scam they at least gave me a letter and a receipt for proof of payment so if someone comes after me i at least have some type of proof that i paid somebody,,,good luck jenn

- JamieI got a phone call from a woman named Leah and Empire Legal Solutions stating that I owed 1400$ from a payday loan in 2006! I never took out a payday loan. When I asked for some type of proof of course I never got anything. I wanted to speak to their legal department and she stated that they do not have one, yet she transfered me to the same guy who decides if he can lower the amount a client owes or not. When I started asking him questions he became irritated wih me because I was asking for proof for something they said I did 7 years ago. I just filed a complaint with the attorney general in California.

THEY MAKE ME MAD!! So I am going to share How to get these [***] off your back.
Don't wait for them to call you back, you call them back. State first thing...my name is___and I am calling you on a recorded line (whether you are or not). My phone number is ____ and I am calling to tell you to never call my number again. Then say, if you are a legitimate business and I owe a debt, then please send me an itemized statement for the alleged debt along with a legitimate business address. Follow with, you are welcome to send me whatever it is you would like to in the mail, but you are to never ever call me again. Then say, everytime I am called, your number is being tracked. If you contact me again, three things will happen: (1) I will sue you for WAY more than whatever it is that you think I owe, (2) I will file a report with the attorney generals office, and (3) I will file a harrassment complaint against you with the police department, and yes, you can get arrested for harrasment and will go to jail....if they are calling you at work, tell them that you will have your employer file a harassment complaint. Be calm, even when they spout garbage and then end it with thank you and have a blessed day and hang up.
The very fact that the state something so fraudulently untrue, such as going to serve you with legal papers is a big heads up that they are full of bs. Generally, when someone is going to be served with any kind of legal papers....a heads up is not given....they just serve you. Check fraud is the same as a hot check...if you had hot checks out, believe me law enforcement would have already gotten you. T tell these douche-bags that misrepresenting themselves is fraud and that you are
Ask them to send you something legitimate in the mail itemizing and indicating what the debt is. AND a legitimate address to where payments can be mailed. Red Flag***They will try to bully you into using a credit or debit card, because they are not a real and legitimate business.
Even if you did default on a loan, all they can do is make a mark on your credit...because that is all that it is ...credit. If you didn't have a payday loan of any sort, then go online and put a fraud alert on your credit and get a copy of your credit report. Dispute anything that looks suspect.
If anyone on your report who has made a bad mark, will not submit to you a legitimate statement itemizing exactly what your debt is, or the original debt holder, dispute it exactly for that reason...that you asked for proof or explanation of the debt and they refused and it will get removed.
Other important note....look close at your credit report....if it is a legitimate debt, but the original debt holder has written the debt off...that means they took it as a business loss on their taxes....they cannot legitimately right off a debt and then sell it to a debt collector....so if there is an item indicated as having been written off by the original debt holder and marked as bad on your credit and then the same debt amount has been marked on your credit by a debt collector as well....dispute that too, for that exact reason, and they will remove it from your credit.The right off by the original debt holder is the only legitimate one of the two that can be maked.

- Lois replies to TiredofharrasingcallsIf they are calling you at work, tell them that their calls are being recorded and tracked and they are harrassing you at place of business and that you will have your employer file a police report and press harrassment charges against them AND that they will go to jail. They are trying stress you out and make you worry that you might get arrested or served papers so that you will cave in and pay them money. They are not legitimate.
- Erin| 1 replyNice job, Lois. Really, well done. I'm a federal prosecutor and will add that (1) they cannot serve you at your place of employment unless it is a fully public venue. They absolutely cannot serve on state or federal property under any circumstances. (2) do not EVER give them any credit card, checking account or other financial info over the phone. If you have a legitimate debt THAT IS CURRENT, then they are obligated by state and federal statute to send you a copy of the proof of debt and all related documentation as well as a demand to pay letter-in writing. And (3) if the debt is older than 5 years (3 in some states), it is beyond the applicable statute of limitations and no one can arrest you or even sue you for it. That's precisely why they bought the debt: it was charged off (written off) by the debt holder. Companies like this operate on fear and ignorance and have to use strong arm tactics like criminally harassing phone calls to fool people into paying them a dime. Just. Don't. Do. It. And if they persist, call local law enforcement and report the threats. They come times get idiot "collectors" who go way across the line and physically threaten you and/or your families. That's absolutely criminal and will land their collective [***] in the pokey every time.
Exercise some common sense folks. They're on the phone, calling about a debt that most likely never existed and even if it did, is well beyond the statute of limitations, meaning they can only make threats; there is literally nothing else they can do. They can't even report you to any of the three credit reporting bureaus since the debt is expired. There are literally no consequences. So if you pay and think that's somehow going to help you down the road, you're sadly mistaken since there's no "down the road" period. Sorry to burst your bubbles if you've paid already, but not only did you hand over your cash unnecessarily, you likely just sold your personal info, including banking info, to a bunch more collection agencies. In other words, you've made yourself an easy future mark. Just don't be a chump twice.

- wendelOne tactic is to ask them if they are licensed to collect debts in your state. If they say "yes" ask for their name and registration or license number, then check the state atty general's web site in your state and try to look it up and see if it's valid. My experience is most states have a web sites to check the validity of state-issued licenses. If they they say "no" or don't answer the question, just say "Bye."
