Same story for me as above posts.  I have gotten a call each weekday for the last 6 weeks and have not called back.  Today it was a voice recording, like a machine, leaving the message. Earlier it had been a man's voice.  Help!

<sigh> they were calling from 800-204-1819, just got a call from this new number this morning.

Recorded message, "This is Pat Clark with an urgent matter of personal business..."  I called and spoke to a male operator.  I asked what company he was with, and he said National Enterprise Systems.  When I said I had repeatedly asked them to stop calling, he became abusive and basically wouldn't listen.  "You never talked to me before, so you couldn't have asked for that" was one of his brilliant comebacks.

    Getting real tired of this...

I keep getting calls from "Pat Clark" with an "important personal matter to discuss with you.  Please call 1-800-234-0228."  I am tired of them leaving messages on a DAILY basis.  At first it was a male "Pat Clark" and and 1-877 number.  I looked it up online and it said he was selling long distance service or was a debt collector.  Now I'm getting a female voice DAILY.  My number is on the DO NOT CALL REGISTRY; they should not be calling me - I have no debt.

I received a call from that number at 12:45pm today. They asked if a so-so was there, I politely told them that they have been calling this number at least 3 times a year for 5 years asking for the same person. I told them that I've had the same phone number for 30 years and that person has never lived here. The lady on the other end slammed the phone down on me. I called back at 12:48pm and got a guy who was just a rude as she was and he hung up on me. I called back again at 12:5opm and asked for the supervisor, I had to really get up mad at this guy before the supervisor came on the phone. I politely told the supervisor that so-so did not live here and he told me that my number had been taken off the list and also hung up on me. That was at 12:55pm. So a total of 10 minutes to finally have someone tell me that they took my phone number of the list. Yes that's right our numbers on a list with many other phone numbers. I'm also going to report them to FTC because I'm on the that do not call list also.

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

    David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.

So what can you do if you receive "wrong number" calls from debt collectors?

    1. Sign up for the Do-Not-Call registry.
    2. Save the calls captured by your voice mail or answering machine.
    3. Contact a consumer lawyer.

Same as everyone else - 1-2 times a day - female voice with same message.  A year and a half later than the first post here, I'm surprised they haven't changed their tactics.

These are scam calls. If it was a true agency, you would be able to talk with a live person at time of call. These new scams will manage to get hold of an unfortunate elderly or mentally  challenged individual, and manage to take their identity. I would like to know how it is possible to get an 800 number and use it for dishonesty. I am on the donot distrube calling list and yet these scamming 800 numbers manage to get hold of pples numbers. And sense they do not know who they are calling it is legal.

So, I just got another of the "Restricted/Unknown Nam/number" calls, actually from a human this time.  The person on the line was a "Victor", asked for someones name, and avoided my questions when I asked what it was about.  I eventually got him to admit to being with "National Enterprise Systems" and that he couldn't say why he was calling.  Upon hearing this, I told him how after researching the callback number I got on the 5 or so messages I had previously received, I had reason to believe that his company practiced cold-calling and false debt collection.  Response:  "...that's...negatory..."  Asked him to make sure his company no longer called this number, was asked if I had another number for the person they were calling for, and were told that I did not.  Thanked me, and said "have a nice day"
There wasn't any yelling or foul language, just the random calls, and dodging of questions.

Used to be if the calling party did not hang up it did not matter if the called party did or not. The line remained open.
