    No one can arrest you
    Thats right, no one can arrest you for unpaid debts except maybe willful nonpayment of taxes. Anyone who says they can is lying AND they are violating the law, a law which you can sue upon. And if they tell someone other than the alleged debtor they are going to arrest them they have violated ANOTHER law and can be sued. Dont be intimidated!

    Also, ALWAYS demand written proof of any debt. You must send your demand in writing as well, preferably by certified mail so you have proof it was sent. Collectors are required to give you their address if you ask and if they dont, another legal violation. If they dont and you cant find them, complain to the FCC, FTC and your state AG office. Put their resources to work for you. Never give out banking info. You WILL get ripped off!!!!!!

    Ok, I'm the idiot that did give the checking account information.  Just like in June Bug's daughter I accepted the secured credit card with Providian in 2000 with a credit limit of $500.  I NEVER used this card and my first bill was over $100.  I admit my credit was munked up.  Four years ago I got a copy of my credit report from each reporting agency and paid all of the debts on it.  When I came home today there was a message from this agency stating that I needed to call & that they'd be open til 9 p.m.  I returned the call & they said I had an old debt with Providian & that the amt. was @ 5000 and that I'd ignored all of the correspondence and the agency had agreed to settle for @ 1300.  She stated that she would be filing a civil suit in the a.m. if payment arrangements weren't made.  I was so upset, when I ask her to explain the bill she began yelling at me.  I told her I'd never rec'd any mail about this & she said according to your credit report you didn't get alot of mail.  I then said if you're going to take that attitude with me if she'd looked at my credit report she'd know (she hung up on me).  I called back and ask her to explain she was extremly rude and wouldn't answer any of my questions.  She said that she'd set the amt up in 3 or 4 payments but wasn't allowed to make any more.  I ask her to let me call her back after I spoke with my husband.  She said no that she was getting ready to go home in @ 15 mins.  I reminded her that her message said she'd be there til 9.  She said she'd just file the civil suit in the a.m. at court.  Like an idiot I gave her my checking & routing info.  After getting off the phone I began researching.  I called the # back after @ 1 hr.  I was transferred to her again.  I asked her hadn't the statute of limitations passed (she said no) and had the account been validated (didn't answer).  She was rude again & said she'd already answered these questions.  I ask her when I'd get info on how this amt. was reached, she said she'd get it from court, compile it, then send it to me.  I told her I called back expecting to get someone else since she'd said she was leaving.  She said that she had to stay & meet with her partners, who'd just got back from a murder trial.  She said, now Ms. SO & SO, I've worked all day and I'm going home now you have a good night.  For some reason I thought about googling a search of the phone # and got this site & info.  I've closed my checking account I've had for 15 years and learned a valuable lesson.  Thank you God for leading me to this site.  By the was the 1st person I spoke to was Ms. Carmax (don't remember what Ms. Green said she was), the 2nd Ms. Green (said she was an atty.)  I'm contacting the BBB, I've already sent an e-mail to attorney general's office, and I'm going to inform my local police.  Thanks to each of you for your comments.

    Well my husbands parents got a call from this suspicious company regarding a civil suit against him and gave this phone # and case #.  I called to see what type of company it was and was told it was a collection agency. So, I then did a google search to find this information and told my husband about it before he called them.  I gave him the heads up that I thought it was a scam. My husbands credit was munked up also, but several years ago we pulled his report from all 3 agencies and paid all debts completely off.  Anyways, he called to see what it was about and the lady he spoke with said it was from an old account opened in 1999 and the statute was November of 2005 and gave the company Associates Financial.  Keep in mind this was creditor of his but it was paid in full several years ago and is no longer in default on hiscredit report.  She really couldnt give any other information, but wanted payment on the account.  He pretty much told her where she could go and told her he didnt owe anyone anything.  she wouldnt listen to anything he had to say, so he cussed her and hung on her.  Tomorrow we are having our family attorney call them to get all legal information and any legal documents regarding their establishment. We will let all you victims know what the outcome is.

    sounds like you took the conversation out of context...if you were listed as an emergency relative reference or contact reach...that info was more than likely supplied by so & so....sounds like your beef is or was with your family member....also sounds like your just out to make yourself a few dollars...an opporotunist so to speak

    This woman called my sister's EX-HUSBAND from over 10 years ago, saying that they have been trying to reach me. Said she was from ESR at 800.375.3009 and told my sister's ex-husband that I was being named in a Civil Lawsuit for attempting to defraud a financial institution.  First of all, if it was attempt to defraud anyone, it would be a criminal suit.  So right away I was suspiscious.  And any outstanding debt I MAY have had that they would have my sister's ex-husband's name and/or number is SO old that it was just ridiculous to think someone would call on it.  Not to mention that now people are thinking I'm committing fraud!

    Rec'd voicemail stating 'you have a civil complaint filed against you, please call this number within 24 hours', so i called and they insisted that it was in regard to an 'old credit card debt' from 1999, that I owed 3589.64, but an out of court settlement was offered in 2004, and i never responded, and another notice was sent to me in January of 2008, and I didn't respond to that either. Advised them that I would have called if I'd gotten the letters. They have my SSN, old address, new PO box address, and phone number that I've only had since June. They want 525.00 TODAY, or I'm being garnished...I'm not sure what to do. I know all my old credit cards are paid off, and this isn't a credit card debt, but I don't know what else it is. They faxed me a letter, on letterhead, stating a settlement amount, do I have any recourse?

    I was so upset and frightened that an investigator called me about a civil suit against a person that closely sounded like the name of my colleague at work. I called the number and they were closed. I was confused why law enforcement would have an 800 number so I looked it up. Ironically, I happen to work with the Northeast region at my job and thought that I did something wrong.  Ironically, I got a call today at my job from a guy that sounded close to the guy left me the message below stating that I was the runner up in contest and stated I won a prize for something I filled out a piece if paper at a theatre (he happened to be calling from a NY number). Then I go home and hear this message on my voicemail. I happened to give him my email address and he verified my information he had, i.e my home address and asked (to claim my price) if I was under single status. he promised to send me an email letting me know about this prize and I was hurrying up because I can't really take personal calls like that on my work phone. I never received an email. I am scared this guy illegally obtained information-they sound exactly the same.

    THIS IS THE MESSAGE STATED-THE TONALITY WAS THAT OF AN INVESTIGATOR INVESTIGATING A SERIOUS, UNKLAWFUL MATTER.

    My girlfriends mom got an answering machine message that a full investigation had been completed on my social security number and that the investigator had to make a decision by the morning. I needed to get an attorney and get in touch with them immediately as I was in violation of the law and could go to jail after I was filed against in the morning. My girlfriends mom freaked out and called me. I researched before calling and what a joke this company is and what tactics. Shame on New York for letting them operate.

    A man just left a msg on my cell regarding someone I have never heard of in my life and stating that there is a civil matter, that he is an investigator, and left a ref number...said his name is K? Williams, that he is a claims investigator, and to get back to him before this matter goes any further.  He ended the call with a very odd sounding "Good Luck"  I called back to let them know they had the wrong number, but got a bad feeling before an agent answered and hung up...then I checked here and realized I was right.  Just in case this person exists and ever visits this page, the name he left the msg for is: Yvonne Denman, case number BR1645.  Not sure what to do since they didnt call for me.  Was it a way to get me to call back?  Sounds like they are the kind of scum who would use such methods.  (Also, they called a second time using *86)  Who knows...maybe I will just ignore them.

    This collection agency does not do it's homework before calling and leaving almost humorous, threatening phone calls. Ending the message with "good luck". What a joke! I actually feel sorry for people who have to do this for a living. I guess they should've listened to their parents and stayed in school.

    I got the same msg that christina posted on nov 6. It was for my mom who lives in fl and I live in Cali. I knew something was off when he called from a ny # but the name of the company was showing as "unknown name". I immediately searched the 800 # and found this site.

    these people called and threatened to have me arrested for a card that I have no recollection of.  I asked if I could get their company address and proof that the debt was mine.  They would not give me any information.  I told them to do whatever, because I am not giving money to them without written proof that I owe these debts. I talked to several creditors, by law creditors have to give written notice, and they have to supply me with their address.

    I also recieved a call from a Douglas Manning that said he worked for ERS and that he had a civil suit against me. He said that if i didnt make payment arrangement that there would be a warrant for my arrest served. He claimed that I owed a bank for a credit card, the amount he quoted was no where the amount i had ever had on a credit card. I was really upset and worried so I called my husband and told him what i was told. He said they couldnt do that. I also called my local sheriffs dept. and was also told they could not do that. I dont remember ever having a credit card with this company that he was claiming i did. I am planning on reporting this company and having this matter checked out further. I really am glad i found this info here cause I was really worried and upset about all of this.

    I just got home from a long day at work and then attending a night class when I hear a message from this company stating that there is a civil suit against me which freaked me out. I called Investigator Davis back and left him a message. I don't know why they are trying to scare people saying that they have a civil suit them.

    I received a phone call May 20, 2009, from Douglas Manning who stated he was an attorney wanted to contact a party I know.  I was told if the party did not respond that an arrest warrant would be issued.  I was to have the party call 1-800-375-3009 and then extension 110.  The party was to refer to case number BW3108CXXXX.

    Pay your bills on time you would not have to go thru having anyone contact you, that is what I learned to do back in the 90's. You put all your complaints on here as if they are taking from you, your the one taking from the bank and every tax payer that end up paying higher taxes becuase of the bank. I can't beleive the things you'll put on here as If you were really threatened.

    I was told that this agency is closed now so no one would have to worry about these people ever harrassing them. I guess the attorney general got a hold of this company and shut them down.
