    who can you report these people to?? I too have not outstanding debt and they called asking me to give my address and last 4 of my ss#, but they refused to tell me  what company they were calling from or what they needed to talk to me about. They just kept saying it was a personal matter. If it's  a personal matter, then tell me what the matter is and I'll verify who I am.

    Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
    "§ 809. Validation of debts
    (a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;
    (3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
    (4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
    (5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

    A Collection Agent May Not…

    Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

    Misrepresent Him or Herself

      A debt collector may not misrepresent himself as an attorney or law enforcement officer.

    Use the Telephone to Annoy or Harass

      A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

    Threaten Arrest or Lawsuit

      A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

    Use Abusive or Threatening Language

      A debt collector may no use abusive or profane language in the course of communication related to the debt.

    Publish a Bad Debt List

      Publishing the consumer’s name or address on a "bad debt" list is prohibited.

    Contact By Embarrassing Media

      A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

    Contact a Consumer at Work

      A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

    Seek Unjustifiable Amounts

      A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

    Contact a Consumer Represented by an Attorney

      A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

    Communicate With a Consumer After Receiving a Validation Request

      If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

    Communicate With Third Parties

      A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

    Bills.com FDCPA FAQ

    Below are questions Bills.com readers ask frequently:

    Can a Collection Agent Call My Cell Phone?

      Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

    I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

      No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

    A Collector Says I Will Be Arrested if I Do Not Pay

      This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

    thank you for the information.   I just got scammed out of over $800.. having to pay the dang bill twice. The first one scared me into it and I got scammed out of  over $675..the second one was correct. I owed it but the place I was paying closed down and sold the accounts to I think about 100 different collection agencies. I just happened to get the worst one.  IF you people ever get a call from Firestone Legal Associates, hang up.  You make payment arrangements, they take it out of your checking account as that's the only way they would accept payment unless you paid it all at once,, then get a paid in full when you're done by a Solomon, Smith and Taylor  Attys.. THESE guys also have a class action suit against them. They guy that was doing it has been in jail for everything from attempted murder to rape and fraud and everything else you can think of.. the one I had to actually pay again, has the suit and assured me that I would be kept in contact with and that they would get my money back for me, but I don't think I'll ever see it, but I went to my BANK with this information and THEY made the calls and got the information. So they were thoroughly checked out and were on the up and up.  I have a paid in full letter along with statements saying that I was included in this lawsuit and gave me their correct phone numbers (because I called the number and got the same lady the bank got).  Please people be careful who you let bully you into paying something even if you do owe it.    I checked on Firestone as well and they no longer exist either.  This was MY fault for letting them do it to me. But after 6 calls in one week about the same bill I had already paid(I thought) I figured it was time to take this to the bank. This lady even suggested going to the bank with it and she would speak with the bank for me.  So if you ever do find yourself in  this situation, please.. let your attorney or your bank do the talking!    Good luck to ME in getting my money back.. even though they say they have already had him personally served with the court papers...  he'll run. Just be careful folks.. MOST of these people  that do not put their names in the caller ID are cons!  Take care everyone!

    Caller ID said:   OUT OF AREA and the phone number.  They only let it ring two times.  I never pick up a call if I don't recognize the name or phone number.  When at home, turn your answering machine off.  If you have an answering machine that turns on after 10 rings, do the following:  After the sixth ring, turn the answering machine on and IMMEDIATELY turn it off again.  Do this every 5 rings or so.  These robo-calls rarely let the phone ring more than 2 or 3 rings, but if they do, this works well to keep your answering machine from turning on.  NEVER, EVER, EVER call them back.  Picking up the call, allowing it on your answering machine or calling them back only notifies them that you have an active phone line.

    Caller ID said:  OUT OF AREA and the phone nunber.  It rang 4 times today.  Look at my post of 18 hours ago.  Never pick up a all if you don't recognize the name or phone number.  Since it says OUT OF AREA, it's a no brainer.  I don't owe anybody any money so if it's a debt collection agency they are barking up the wrong tree.  Can anyone recommend a good call blocker?  I need a brand and model number and where to purchase.  Thanks for any help you can give me.

    Do you have Caller ID?  I would suggest that you get it if you don't have it.  If you do have Caller ID, just make it a point not to pick up the phone if you don't recognize the phone number or the name.

    Well, just received yet another call from Allied.  They were looking for someone named Randy, but couldn't pronounce his last name.  I have been harassed by them for another alleged debtor and have sent them a cease and desist letter.  I have also contacted various agencies.  Both seem to have NO AFFECT whatsoever.
    Glad to see my tax dollars working so hard to govern debt collectors and telemarketers.  Everyone assumes when a debt collector calls you, you owe money.  More likely they are looking for friends, neighbors or relatives and could care less if they call you repeatedly even after you have notified them in writing not to.
    The biggest offenders are Allied and Calvary.  Know your rights and maybe we all need to get a class action suit against these bullies.
