A man named Richard Bender called my house @ 9pm and claimed that (I) not my husband owed a debt then proceeded to tell my husband all the details of the debt including that I had wrote a hot check for a payday loan and as well gave out a checking account # that was connected to the hot check.  He stated that he worked for the law office of Smitz & Caine. My husband asked how they acquired the debt and he then stated that they had purchased the debt, so my husband said “so you are a debt collector” he then stated "NO" that they were a law firm and he was a paralegal and that they were not a debt collector.  
If he was really associated with the Law office of Smitz & Caine as he said, then he should know that unless I had given him permission to speak with anyone else about a debt that he claims I owe then he should have never proceeded with the conversation.  How could he possible know that the man who answered the phone was in fact my husband?  It is against the law to describe in detail the facts of a debt to anyone other than the debtor unless given permission.  My husband then asked for the Company name again and physical address as well as the spelling of this company name to ensure the creditability of this company but the man refused to give my husband a physical address of the company he was claiming to work for.  When my husband told him we would need a physical address not a PO Box he told my husband "then I will be marking you down as a refusal to pay" my husband tried to tell him we just needed more information about whom was calling and the creditability but the man hung up. "Real professional".
Another funny thing about this is about a week before this call I received a voicemail from a man stating that he worked for the same company and his name was Marcus Johnson  and that I needed to return his call at 716-931-5918 with a different account number than what Richard Bender gave. Some one call me from that number and ask if i could pay my bad check for a loan that I took out some time in 2008

 This company called my parrents and claimed that I had a fraudulent check and that I put my mother as my backer.  I NEVER put my mother as my backer for anything so I have not idea what they were talking about.  Gave my parents the name of Smitz and Cain Law Firm and the phone number 800-656-5732 which I have attempted to call several times and always receive voicemail.   They stated if I did not pay I would be served papers and both my mother and I would be going to court and possibly jail.  Can someone please tell me if this is bogus????

no debt collector can put you in jail nor can they they threaten you, contact the attorney generals office, and they can send you paperwork to fill out for them to go after the company that threatens you.  If you record the conversation you can actually sue that company and they will have to pay you money.

DO NOT GIVE THESE PEOPLE ANY OF  YOUR CHECKING ACCOUNT INFO. A man by the name of Richard Bender called my work, my brother, and my mother's house.  He told my mother I was writing "hot" checks.  When I called him, he said I owed for Pay Day Loan-Yes.  I was told the total I owed was $1,200 but he could settle for $500.  He set it up to come out of my checking account 3 different pay periods.  Luckily today I e-mailed the company to see if I could pay them directly and they told me I was paid in full and this was a scam.
