I received a call from 800-797-1412 2 days ago, I answered the phone and said hello, the person on the other end of the phone ask for a particular person and my reply was sorry you have reached the wrong number. The man asked me again I would like to speak to " particular person" my reply was as I said before you have reached the wrong number. I asked the man to remove my number from the call list and to never call my number again. The mans reply was I need you to answer some questions for me my reply at this time was ()*&(*&$#@! don't call this number again and I hung up the phone. As soon as I hung up the same number and the same man called again, he tells me that I have to answer his questions and I explained to him I didn't have to answer anything and he could *+&%^%^$%^$#__))**^^ himself. My next comment was DO NOT CALL THIS NUMBER AGAIN AND I AM REQUESTING BY LAW YOU DON'T CONTACT ME AGAIN AND TO REMOVE MY NUMBER FROM THEIR DATABASE AND I hung up. As soon as I hung up the phone rings again, I give this man a real piece of my mind and explained that I will be reporting him/his number to the FCC.

This company is a scam Please PLEASE PLEASE do NOT believe them, I have tried finding out if they are legitimate through the BBB, Virginia Attorney Generals office, secretary of state and also filed a complaint through the federal trades commission, first this so called company called my daughter and said tell your mother to call us because we are sending the police to arrest her for check fraud, I then called this Mr. Shapiro who said I would be arrested and brought to court for a online sonic payday loan I took out over 6 years ago, he stated that since I took this loan out and gave the company my checking account information that this was considered a bad check and I will be arrested for check fraud, so I asked him to send me a bill in the mail and he refused stating that the statue of limitations is almost up and I had to make an immediate payment or be brought to trial and I will go to prison, I then gave him my credit card information to make a 20.00 a week payment and after talking to several people they stated NEVER NEVER do this unless you get a bill in the mail so the following week I took all the funds out so that the payment wouldn't go through and this Mr. Shapiro was screaming at me at the top of his lungs, I have been contacted by dept collectors in the past and NEVER had any one of them ever screamed at me in this manner or tone or asked for credit card information over the phone, please do not deal with this company, they are a scam and the federal trades commission told me they are going to TAKE THEM DOWN!!!!

    A couple of things:

It is the debt collector's burden to collect the debt.  That means that if the debt collector calls someone and is told by the person that he talks to that the debt collector has the wrong number.  That's the end of it for that number.  The person who's been called is not on the hook for any proof, investigation, of responsibility for finding the person that the debt collector is looking for.  Hounding the person that answers the phone won't get the debt collector any closer to their victim and, well, might put the person who answers the phone in jeopardy.  By and large, these people are criminals and will use any information that they get to make money.

And, as an observation of many, many of these forums, attempting to replace things like demand letters and proof of debt files with the telephone won't work.  It's the sign of a scamster when the person calling you makes demands for money but refuses to put it into writing - a reason for simply not answering the phone when these scumbags call.  By law, these idiots have five days from the date of their first call to get something to the person they are calling IN WRITING via the US mail.  Replacing that with more phone calls won't work.

Oh, and also, showing up at 800notes and pretending to be 'satisfied' customers is not an acceptible substitute for either 'putting it in writing and into the US mail' or 'proving that you've got the right person on the phone.'

This list of bogus comments is yet one more reason why 3rd party collections should be abolished.

Since the room has taken on a sudden religious character, I thought I would post these:

1     “I am the Lord your God, who brought you out of the land of Egypt, out of the house of bondage. You shall have no other gods before Me.

2     “You shall not make for yourself a carved image, or any likeness of anything that is in heaven above, or that is in the earth beneath, or that is in the water under the earth; you shall not bow down to them nor serve them. For I, the Lord your God, am a jealous God, visiting the iniquity of the fathers on the children to the third and fourth generations of those who hate Me, but showing mercy to thousands, to those who love Me and keep My Commandments.

3     “You shall not take the name of the Lord your God in vain, for the Lord will not hold him guiltless who takes His name in vain.
    ...
    8     “You shall not steal.
9     “You shall not bear false witness against your neighbor.
10     “You shall not covet your neighbor's house; you shall not covet your neighbor's wife, nor his male servant, nor his female servant, nor his ox, nor his donkey, nor anything that is your neighbor's.

Assuming this sudden wrapping of oneself in a religious shawl is what I think it is, I think some posters here may have a problem...

And just what sort of talk would justify the caller violating the FDCPA and/or the TCPA ?

These Federal laws required this caller to cease communication, and they apparently chose not to do so.

Is there something wrong if a collection agency seems to constantly violate the law, or to collect monies which are not owed?  Or is that just fine, because that is how you are making your living?

You are right, it might be.  Or it might be an ex-con on parole, a drug addict, a sex predator, an extortionist, or a petty thief.  The range of possibilities boggles the mind.

Dreams are a funny thing.  I guess that you had the dream that you just described, and I dreamed that I was on 800notes reading a bunch of transparent lies.  I wonder which one of our dreams was the closest to reality?  Ah, well, dream on my friends, dream on...

No, I meant "our", as in Doug's apparent hallucination, and my whimsical extrapolation.

NAR seems to be in line with other scams that are proliferating at an extreme rate. NAR appears to attempt collections of questionable "payday loan" accounts. The fact that they self-proclaim themselves to be "investigations" is a false and misleading statement, illegal under the FDCPA. This is an attempt to scare you into believing that they are law-enforcement agents investigating "bad checks". The bad checks claim is also illegal. Taking an internet payday loan does not qualify as a "bad check". Furthermore, actual law enforcement would not typically give you a "heads-up" before they would process your case. You would simply have a warrant issued for your arrest if you had in fact, written a bad check. No fly-by-night collection agency would contact you. At worst, these individuals are scammers attempting to steal your money or personal information. At best, they are bottom feeder debt-buyers attempting to collect debts that they are not legally entitled to collect. They will threaten arrest, lawsuits, etc. Don't hold your breath waiting on this to happen. Contact the FTC and your local law enforcement to file a complaint. You can also contact your state financial regulatory agency as well.
