This is one of the worst ‘Collect America’ operations in America that we receive complaints on.  Most are of collectors threatening legal actions, wage garnishments, seizure of assets and notification of employers and third parties about debts. Scheer employs some of the most hard core debt collectors in Florida which gives credence to the position that you make more money when you break the law than when you obey the law.

Some of the more criminal type complaints received are on Collector Gary Ridge, a former manager and one who used an alias of ‘Attorney John Morgan.’ His REAL name is Jung Yoon, the alias is so he could threaten and extort monies from consumers. Rumors have Yoon going so far as to cancel phone and cable service and even credit cards for unruly consumers.

We have information that a BIGGER crime wave may be going on within the Scheer organization, including possible illegal credit card debits and more, so if you have an account in collections with them, you may want to pay close attention to your credit bureau reports and credit card activity.

The good news about problematic Collect America franchisees is that their management and legal folks do take actions to correct problems. If enough people complain about Scheer, we will get that information in the right hands so they can be dealt with. Complaints regarding Scherr should also be directed to the Florida State Bar authorities at: http://www.flabar.org/tfb/

Tape record Scherr collectors where legal, make them validate their claims.

I was called regarding a debt, my son's debt that I cosigned for. My son had lost his job and got behind in his payments. I called the company the debt was with last month (Jan. 2009)and paid the account in full. This company was large and sadly one hand did not know what the other was doing so while one hand of the company settled the debt with me another hand of the company sold the debt to someone that this law office represented. So last week I received a call from an attorney. We played telephone tag until I spoke with them yesterday. They told me that the delinquent account had been sold to them and that I had better pay them all of the money now or they would start legal proceedings against me. I was shocked at this information and explained that I had paid the account in full with the original company the debt was with. This person assured me that I had not and that it was in my best interest to cooperate. They gave me one week to come up with the money. I went home last night and verified that the funds had been taken out of my bank account by the company with the original debt. I called them yesterday evening and confirmed with them that they had received the funds, that the account was paid in full, and was being closed, all of which they confirmed. I told them about the call from the law firm and they said that was a mistake and that they would take care of it. I called the lawyer this morning as I told them yesterday I would and told them the story. They would not believe me and wanted proof. Since my bank statement did not have the name of the company the funds went to on it they would not accept that as proof. I told them I was not going to argue with them that the account was settled. I was transferred to another attorney who again demanded proof and would not believe my story nor would he call the other company to verify my story. He said the burden of proof was mine and began to threaten to call my employer to attach my wages as well as other legal action. I again called the originally company which is when they discovered the error of settling with me and at the same time selling the debt. They took full responsibility and said they would buy back the debt and close it with no further cost or action required on my part. I asked them to call the law firm to confirm the story with them but they said they could not make outside calls but with my approval if the law firm called them that they would explain the situation. I called the law firm and told them the story which they would not accept and they still would not call the other comapny to confirm. I was told that they were going to turn my records over to the attorney in charge and he would decide what to do about it.

I have never had a debt problem and have never dealt with a debt collector before. I have never dealt with anyone so demanding, unprofessional, and uncaring about the truth though they claim to be lawyers. I have never been threatened like that before. All they cared about was getting their money and right or wrong, truth or error, who was responsible or not, did not matter at all. They refused to make just a simple phone call to verify my story to resolve this and they treated me like dirt.

I do not know if other collection law offices work this way but this office has earned my displeasure. No ones deserves to be treated and hustled the way they did me. People need to take a stand against this.

These guys start calling my phone at 8:01 every morning and do not stop til 8:00 at night, I think I get 15 calls a day from them. I get frustrated because for a long time there was never a message left, they eventually started leaving messages on occassion with the Harold E. Scherr name. I have delt with debt collectors for a while now, being laid off twice will do that to a person. I have one thing to say to anyone that has to call an aggressive collecter such as this one... YOUR LIKELY MUCH SMARTER THAN THE LACKEY ON THE OTHER END!!! Odds are it is some pimple face high school drop out who learned a few big words from the person training them to be yard dogs. Be firm, you have all the control after all its them that wants your money, dont be afraid to remind them of that... They can either collect the money as your budget allows...OR they can get nothing. Sure you know they will get it one way or another if you are employed however, there is a reason they harrass for so long before it gets turned into a judgment or garnishment... because once it gets handed over, they see very very little of the money.

Received a voice message from "Kevin" from this number stating they were looking for my ex-husband and were given my name as a contact.

I suspect this is a debt collection agency.  How do you get rid of these calls?

My father-in-law received a call from this law firm asking him for my phone number.  That was at 7:54 pm.  I immediately called this number and of course they were not there, so I left them a message and told them that I would need specific information and paperwork, their fax number and the full name of the person calling.  At 6:25AM the next morning, I received a call from these people.  I said to them, "Do you realize what time it is"?  Their response, "No, I am sorry, I just listened to your message and was returning your call."  Then they asked me for my address and phone number.  I said they could call back in the afternoon and I would obtain information from them, and then send them a letter.  But, before we hung up she asked for my phone number, and I responded, "you just called me, you have my number". Her response was, our phones just automatically call the number.  Oh, and when I started asking her for information, she said she couldn't find anything.  I told her she shouldn't be calling people unless she knew what she was calling about.

I have had some credit card debts totally to around $37,000 on 3 cards.  They happened mainly due to some medical issues in my family.  They occured due to multiple surgeries every year for a 10 year period.  Even with insurance they kept coming and overwhelmed my ability to pay.  In the end, I myself came down with the flu back on February of '08 and got behind on a bill by a week.  As a result, all 3 cards raised their interest rates from 10%-12% to 28% to 32%.  They would not work with me no matter how high I climbed on the food chain so I just defaulted.  I did not have the ability to pay those high payments they wanted.

This gets me to the last few months.  I received a call from these idiots.  What they did not bargain for is that I have had some legal training.  I live in Florida and I know what they can and cannot do as far as my situation.  Please don't ask me as far as your specific situation as that can get complicated.  I asked the guy if he had proof that I owed the alleged debt, and he said we do and we will sue you if you do not pay.  I told him, go ahead, I am judgement proof.  He tried to tell me I am not.  I simply told him that under the 1974 Fair Debt and Collections Act that he was not to contact me other than by written letter or I would not only sue his employer but would go after him personally, and I would find out who he was when I filed a motion for discovery.  He had a funny change of demeanor.  I asked to talk to his supervisor, he refused.  I said I do have the right to know who accuses me and I will turn around and sue and force that issue.  He asked if I was a lawyer, I said..."I am not a 'Practicing Attorney' in the state of Florida...but I have had some legal traning."  They are trying to sue me now and they will get NOTHING.  Even if they get a judgement against me, I am jugement proof.

They tried to call a few days later.  I turned the tables on them.  I told them I would only talk if we could record the conversation, I said..."no record no talk!".  They refused so I just stone walled them. I tried playing that game a few times finally they relented but they were very polite after that. There is more than one way to deal with these idiots and have fun with them.

These idiot,scumg-bags have been calling me for months about someone I HAVE NEVER HEARD of or know at all. I finally called them back and told them I was contacting the Texas Attorney General's Office about them. How incompetent to  be harassing someone who doesn't even know the person. If they call me again, I am contacting my attorney. After reading these posts, I am turning them in to as many agencies as possible.

I too have just been contacted by a family member that this low life firm has been calling them trying to obtain my number. I have no interest in speaking with these cretins as they are just a bunch of buffons and will get not a dime from me. Thanks to the current economic condition of this country I no longer have a job so get in line and wait your turn.

Just for good measure I am going to report this matter to the Flordia Attorney General.

This company keeps calling me during nap time for my children. They are calling for my sister in law, and won't stop calling at all. I have explained that even my sister in law doesn't have my new home phone number but they are calling anyways. The seem very slimy and rude. My sister in law has said when I have called her about it, that they won't give her any proof of debt, they just keep telling her that she has to pay them immediately or else.

Got a call New Years Eve with a threatening call to my mother via my owned phone line. They sent multiple pieces of mail and harrasing phone calls stating that she owed money for furniture that she signed for credit wise. She never signed for any furniture, she has no furniture and I did our free report from the big three credit companies and its not listed anywhere even in the outstanding debt section. They have no information. The guy Iroh said my mother owed $2,937.85 and he would settle out for $881.35 Im about to call him back stating that since he has been contacting my phone and since my mother doesnt own one this is considered harrasment and i will be going to the attorney general of Texas about this matter.

} He said the burden of proof was mine and began to threaten to call my employer

A scofflaw debt collector would like you to believe this fiction, but said scofflaw actually holds the burden of proof.

} have never dealt with a debt collector before

... and sadly missed the big pile of FDCPA violations in that story. Fred could have sued for relief before Feb 2010. I hope he did, but somehow I doubt he knew what was illegal for the collectors and possible for him. History doesn't have to repeat for you.
