    A few unanswered calls during the week then I received a call at 11:30 this evening. I answered but heard no one. About 11:35pm they called again but I did not answer. No vm.

    This is one of those companies that purchases noncollectable accounts for pennies on the dollar and the uses every underhanded trick in the book to try to collect.  Money paid to  them does not go back to the original creditor.  It goes into their pocket.  If they only collect on a few of these accounts, the make out quite well.

    Caller identified herself as Jessica but wouldn't tell me what the call was regarding.  Mind you she called my place of work asking for one of my employees.  I don't operate that way.  Not allowing you to harass my employees while they work Jessica.

    Jessica called my husband at his job regarding my over due hospital bill that was in the process of getting taken care of.

    I feel harassed, if I don’t answer she calls my husband. The whole thing is weird because the first time I ever picked up one of many of her calls I had no idea what it was concerning because I thought the bill was taken care of. I told her we could set up a payment plan, she ends up adding it to my credit, and the way it was added to my credit was strange. She did it in a few hundred dollars. I know I was slow in noticing but I am naive and now I feel strange about the whole thing. Please help! I don’t remember what the company she said she worked for because I don’t want to answer her calls anymore

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
