- AmarilloCaller wanted me to verify my date of birth. When I told her, I didn’t feel comfortable doing that, she sighed and said, “I just need to verify that I have the correct person” I declined to answer that and requested that they mail me a letter.
She stated, “just know we can report you to a credit agency”. - Amarillo ResidentI also was asked to verify my date of birth without any context or understanding of who I was taking with. I asked who I was talking with the person said their name was Sue Palmer, but she was unwilling to tell me what organization she worked for or what company was requesting me to verify my birthdate. It turns out that the company is a medical debt collection agency named Account Recovery Services Inc. or ARS. I felt that the whole encounter was unprofessional and felt that the organization was perpetrating a scam. It a shame that if there was a real issue that needed to be resolved, that the organization couldn't ack in a professional way to resolve the issue.

I have been harassed at work without providing a reason why. I have asked many times for them to either tell me what they want or quit calling me. I have asked for a letter if it is a legitimate debt as I pay my bills in a timely manner. I have yet resolve this or for them to quit calling me. My work place is getting tired of this, the only reason I answer my phone is because my son and husband have health issues and my daughter has been having problems with her mechanical heart valve.
- BigA replies to S. RiveraLooks like they are located in Arizona. You have the right to tell them not to contact you at work and they are legally required to honor that request. From the way their website looks though it it certainly not a professional outfit. I think a newborn baby could have designed a better looking website. You need to send them a certified, return receipt letter on a company letterhead telling them to not contact you at work.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

They have sent letters, addressed to me with the incorrect last name (it is my husband's last name, but it is not my name and I have never used it,) and the dun letters do not include a creditor's name, only an dollar amount I supposedly owe.
