I EMAILED THEM BACK IN RESPONSE TO THIS WITH THE FOLLOWING:
I would like to see a verification of debt letter with any solid evidence to back up this claim, which I never received. I need more than just a strangers word on such an important matter as this! You will have to mail me in writing all the details and transaction #'s, who authorized said transfer, exact date of any transaction, ect. In order to make payment I need the company's address, license #, ect.
Also, the biggest thing is the fact that I KNOW I never failed to pay a loan back or even took one out in the first place...so this is being forwarded to my local law enforcement and to the FDCPA and will have a complaint filed.
THEY QUICKLY RESPONDED BUT WITH NONE OF THE INFORMATION I REQUESTED. ONLY THIS IN THEIR REPLY EMAIL:

Dear Scammer:
I would like to take a moment to send your bogus letter back to you. You see, there is no proof that I have some debit with a payday loan company. If I in fact have a loan on file, someone has committed fraud against me. Additionally, your attached letter really details nothing other than the name of the company, but no supporting documentation, as in an account number, and electric signature by me, not one thing that legitimizes your claim. With that being said, I’m fairly certain that your claim is in fact not true, and a feeble attempt to obtain funds from people who don’t know any better. I, however, do. So much so that I’m not responding to you from my personal email that you sent your fake claim to, but rather, my corporate email address. That’s because if you choose to respond, you are violating quite a few laws by contacting me at my place of employment, as well as a term that you may not know, called “Phishing” – which could lead to your IP Address being tracked and YOU being subject to prosecution. So, I’ll play your little game…let’s see if you’re stupid enough to play back.
To start, you should truly know the rules of grammar before trying to scam someone with my level of intelligence. Let me just point out to you WHY I know that you’re not legitimate:
1. Subject line reads “Payment Over Due” – Overdue is one word, not two. A lawyer would not mess that up.
2. Sender details have “to bcc: me” – not very smart on your part. That just means that this email went out to a [***]-ton of people and you hid it by blind copying yourself. This REALLY makes you look stupid.
3. Senders email kladebtdepartment@gmail.com – this is fact is NOT from Mike Livlighan, Esquire – and I will tell you why if you choose to read on.
4. “National Checking Database System” – no such system exists. Try again.
5. “You have never been charged for a fraud activity” – does that mean that there was fraud on my account and I’m entitled to protection?
6. “…or else the complete law suit amount once the case is downloaded against you in the Court House” – well, this is funny. Lawsuit is one word, not two. Cases are not “downloaded” against people. And best yet, “in the Court House”? Which Courthouse is this? Again, one word, not two. I’m actually giggling to myself at this point.
7. “you can get some percent deduction on the Restitution Amount and you can take care of this issue by making the payment of the Settlement Amount today which is $320.00 and You have to send us a promissory note to stop your case file temporarily out of the court house.” – Well, talk about a run-on sentence. I could chop this into a million pieces. Let’s start with the bad grammar (which, I will repeat, a highly educated lawyer would not get wrong).
a. It would have made sense had you said “you are eligible for a reduction in interest if you’re able to pay the settlement amount today.” – Just a thought for the next person that you try to scam.
b. “You have to send us a promissory note to stop your case file temporarily out of the court house” – again, which Courthouse? (Still only one word, by the way). Promissory note? You’re joking, right?
8. Moving on…
9. “Kindly be notified that you are going to be legally prosecuted in the Court House within Three days. Your SSN is put on hold by the US Government & Social security Services.” – I thought I had to pay the settlement amount today? Now I’m confused. Oh, and the Government and SSI don’t “put a hold” on your SSN. I’m laughing really hard at this point, if you wanted to know.
10. “If we do not hear from you within 48 hours of the date on this letter, we will be compelled to seek legal representation from our in-house attorney.” – But, aren’t you an attorney? Again, I’m getting really confused, here. Your letterhead is clearly from “Kivlighan Law”…even a law office clerk would send out different verbiage, because it’s created BY THE ATTORNEY, again, indicating that you messed up.
11. At present, KLA INC is seeking either of the following remedies: - a) All funds to be returned as per terms of initial contract OR b) Press charges against the defaulter. – I seriously hate to break this to you, but one of your cohorts tried to call me over a year ago and tell me the same thing. When they couldn’t provide legitimate information in regards to who they were, or my supposed “case”, they threatened to press charges and send a sheriff to my address immediately. I’m still waiting to be arrested, and I’m sure that I’ll be waiting again. P.S. – nobody gets “arrested” with a debit lawsuit (see how I used one word instead of two there, unlike you?). Please try this with someone else, I’m too intelligent to fall for it.
12. “Dear CUSTOMER” – Well, this was your biggest mistake. There is not a legitimate lawyer, or law office, on the face of this earth, that will address someone by “customer” over a legal matter. They would address that person by their name. again, confirming my comment in bullet #2 that stated that you have sent this out to a mass number of people in hopes that one of them will buy your [***].
13. “…as we were investigating your profile, we found you to be a genuine person so it is our duty to help you out but for that we need some right answers from your side.” – Thank god! I was starting to worry that I wasn’t…crisis averted. As far as needing “right answers from my side”, I asked my side, but it didn’t answer. I guess it pled the 5th. It’s asking for a lawyer before answering any questions that may incriminate it…can you represent my side? No? Oh, ok.
14. “This is our final notification to you as we found you to be a genuine person as told you before.” – As told you before? Are you missing words there? But again, SO glad that I was found to be a genuine person. I like the word authentic, myself. Maybe even real. But still, so relieved. You have no idea how much I appreciate your confirmation.
15. “You have to give us a flat answer without any excuse.” – I am so glad you saved this until almost the end. The laughter is uncontrollable at this point, and I was having a terrible day. Thank you so much.
16. If you do not reply to this message or fail to make payment then legal action will be taken & you will be arrested today. – Well, just like I stated in item #11, I’m sure I’ll be waiting longer for this to happen. Also, you can refer to #11 as to why this is [***], people don’t get arrested for debt cases, especially bogus ones. You might want to brush up on your criminal justice education before making these threats, it makes you look mentally [***]. Not to mention, your letter also references “three days”, so you do the math. 1+1 does not equal 3. Something like that. You’re a moron.
17. If you want to resolve this matter then reply back to this email immediately. – I did at least fulfill this request. And had a good laugh while doing so. I feel sorry for people who fall for this, but rest assured, there are quite a few websites dedicated to this specific scam. Isn’t that ironic? But I bet you’ll still try as hard as you can.
Let me end with this. You have been reported as a scammer. I am notifying you in this email that if you contact me again, you will be reported for harassment as well. Do not email me, do not call me, and for the love of god, stop stealing Mike Kivlighan’s information…even HE has reported that you people stole his name.
