FYI this same company tells you to call 888-705-3896 to speak to a “case manager” - they claim to be lawyers involved in filing a civil judgement against you but somehow can’t tell you anything about the case? they called my mother pretending i gave them her number, told me i would have my wages garnished, that my former bank was suing me. it’s a scam.

They refused to verify the debt, what kind of debt, or anything about it. Just told me I was being charged with fraud and attempt to defraud and I owed over $2000. Said if I didn't pay immediately, I would owe over $3000 . Refused to give me anything in writing. They attempted to get personal info from me. They said they would garnish my wages and didn't need a court order to do it.  The phone number on my caller ID is a different number that is a Google Voice number, the company name doesn't exist, they refused to give me the address.

Fraud and attempt to defraud would be criminal.  That could only be handled by the Police, Sheriff, and the District Attorney.  No scuzzy criminal pretending to be a debt collector can file criminal charges.  They are required by law to send a dunning letter out within 5 days of your conversation.  I am sure that they won't.  They do need a court order to garnish wages (if that is allowed in your state) but to get that court order they have to file a complaint, properly serve you, and eventually present enough evidence to the judge that they win their case and get a judgement.  Won't happen.  What was the company name by the way?

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1

Also file a complaint with your State Attorney General's office.

Same thing just happened to me. Had my husband call back the 1-888-712-5323 they left. The woman wouldn’t tell him what kind of a company it was and what the ‘case’ was in reference to. Total scam.

Claim to be legal firm called 'SLS Associates' with a lawsuit pending against me for a fraudulent account I never opened. I told the receptionist I'd been a victim of identity theft and she said she didn't want to hear it AND HUNG UP ON ME. I called back and asked politely for her name, she wanted to know why I wanted it. I told her bc she is very rude and I wanted to know who to complain about; she then claimed to be the mgr & said I'd have to complain to HER, so I hung up on her instead. She gave no information about this 'pending legal case' and was staggeringly unprofessional.

Just called me spoke with someone by the name of Natale Martinez, said i owed US Bank ( a bank i have never had) said i owed them about $2,000 for debit. I informed her i don't have this reflecting on my crdit report. She stated because it had not been reported to the credit burro yet, however, if their law firm had purchased my debt it would of had to be reported to on credit report correct? Also told me they are going to garnish my wages if i did not resolve this issue. She was extremely rude said it was not her job to inform me of anything only to mandate a resolution. I asked for the documents to be mailed out to me she said she can not mail anything and conveniently their systems were down at the time of the call.  She asked she could call me back on her person number 909-200-3839. I was told the law firm was named S&O associates. They had the last 4 of my social and an old address.

Only if the firm they purchased it from had reported it.

Well, as a "law firm" they should know that they cannot simply garnish wages (if it is even allowed in your state).  They have to file a complaint with the court, serve you, give you time to answer the complaint, win their case, get a judgement and then request that the judge sign a garnishment order.  Whole lot of time and effort in that.

Debt collectors do not "mandate" anything.

And yet the laws says otherwise.

I can't find a company website.  There is a company in Maryland but I don't know what they do.

Whenever someone tells you that they are a "lawyer" or that they work for a lawyer or law firm, the first question you should ask is what state(s) they are registered in and their BAR number for that/those state(s).  Then go to that state and check them out, contact them directly using the information in the state registration, as these crooks have been known to research real law firm names and attorney names and impersonate them.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

If you haven't already, read the very informative post just a few above yours written by BigA. Oh, and it's credit "bureau" not "burro". A burro is a donkey.

I've been blocking numbers from California for 2 weeks - when I answer it is an automated man voice, telling me to press 1 to speak to my case manager, then a woman speaks to me and said she can only speak with the 'defendant'  and said my full name, she referred to me as the defendant, so I didn't give her any information and asked her what the call was about and she said she couldn't speak to anyone except the defendant again - so I told her to take my phone number off of their call list because it's a scam and she told me to be quiet, that I was making a fool of myself, so I told her not to call me again and she told me to be quiet again and so I told her she was making an ass out of herself ripping people off every day, then she hung up on me. I blocked 818-273-5143 - Sunland CA is how the call came through on my cell.  They have an old address for me, and the last 4 of my social.
