    One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them and they can scare that person into paying their extortion money.  They often call people that have never even been associated with you because they get erroneous information off of the internet.

    The fake process server/location specialist scam usually contains:

    They mention that they have received a Fax document or that some sort of complaint has “come across my desk” and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and have to be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.

    "This is the office of Johnson and Whitner we are contacting you today in regards of an investigation to reach and locate ________. If you could assist in providing any contact or location information for ________ or any representing party; please contact our office at 1-833-873-0290"  then the case number with one letter and three numbers.

    This was the above voice message I received.  My husband was called 4 times with the same message about his ex.  What got me is that they pronounced my last name correctly.  No one, I mean no one, can do this ever.

    After a simple Google search, I discovered that there was no such office with that name and found this number to be listed as a potential scam.  Ugh!  Needless to say, I did not contact them. Number is now blocked from my phone.

    I got a voicemail from a phone # with a local area code, 360-995-0620.
    The voicemail said:
    "This is the office of Johnson & Whitner we're making a documented attempt to reach you today regarding a certified notice in our office regarding your ____ road address. You or your representing counsel needs to call us back at 833-873-0290. This requires your immediate attention. This pertains to case reference _____. Again, (insert my full name here), your failure to take immediate action will result in further attempts by Lincoln county."

    I did a Google search as well, and found the # listed as a scam. I believe this is the same scammer that has called me before, leaving a name of "Kevin Francis" with JW Services (also a company that doesn't exist). DO NOT call the # back, THIS IS A SCAM AND THEY ARE TRYING TO STEAL YOUR INFORMATION AND MONEY!!!!!

    I keep getting the same messages. Called my boyfriend which made him mad and wanted to know how they got his #. I had to explain to him how scammers get our information. They claim I have an old payday loan with an old bank account from 2017, which is funny because I never took out a payday loan in 2017 and the bank account he is referencing is an account that I haven't had since 2015. I just got another one today Fri 5-24-24.

    They called my husband and told him I had a cash app loan out from 2017 with my old name and I needed to pay it off today or it was going into collections. Had him all worked that I owed $2,610 to something that I didn’t.

    I've gotten 2 calls now that left messages.  This was today's:  Hello ___________ my name is Kevin Francis with JW&Associates.  I'm making a documented attempt to reach you today now the 8th of October.  This will be the final documented attempt to reach you concerning the civil complaints in our office for your name and identification number ending 2413 from BB&T Alabama and Northwest Financial.  At this point in the investigation we have made a number of attempts to reach you and your blatant disregard leaves no recourse but to accept your silence as a direct refusal and we have been instructed to submit the information via Morgan Accounting. If you have questions or concerns regarding the notice to (inaudible) you or any representing parties are urged to call 833 873-0290 regarding case V372.
