Scam call

I was called by this number and told I was about to be served for an account I have never had or used. The people try to intimidate via reading all of your personal info over the phone to you and claiming " they have your life at a touch of a button." That is a quote from "James" supervisor

The fake process server/location specialist scam usually contains:

They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and have to be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.

I got a call from a different number that actually belongs to a hospital. They claimed they try to get in touch with me to serve me, but we're unsuccessful...but someone is always home here and we haven't gotten any mail or phone calls previously.
They gave me another number and a reference number to call and told me I only have 30 minutes. But never told me what would happen after 30 minutes. Lol
It was a foreigner. So I called the second number and they answer Montgomery and associates, but there's no Montgomery and associates anywhere around me. Again these people also sounded like foreigners. Both first and second callers we're also in very loud offices. Lots of people making phone calls. I hung up on the second caller after they said the company name. Don't trust this I'm almost positive if I was to be served it would be in person. I never heard of process servers working over the phone. Lol

Definitely a scammer. The number that they called from is 409-632-8008 which is (conveniently) the same number as my hometown area code - a place I haven't resided in since the early 90s; however, in the message they said I had to call 833-933-4197. Their voicemail:

"Attention please. This call is regarding case number 20231042323. This is David Jones with Process Server Verification and we are making our final attempt to serve a court summons to the property address attached to this phone record. The documents require a signature for property service and delivery. Someone over the age of 18 must be present and available. Contact the agent's legal department for further information at 833-993-4197. Failure to communicate with the office will result in penalties and fines under Title 18 Section 1501 - willful evasion of service."

Final attempt, eh? Not today, Scammer. Not today.

Left a message stating that they're try to serve a court summons, blah blah blah.  I don't owe anyone.  Someone got my sister's number and scared her

Stacy, Thank you for posting. I just got this exact message except different name of caller, caller ID said 210-812-3674.  “Serve a court summons to the property attached to this phone record.” Was told (threatened with penalities— yes that’s how it was pronounced) and the callback number was the same, 833-993-4197. Final words, “You have been notified.”

Received a call from 407-842-4307, stated they were process servers with case number 20231038792. I called 833-933-4197, and they identified themselves as Montgomery and Associates. Would not provide further information. Upon searching for the case number through the clerk of the court, no records of this case exist.

Left voicemail…with mothers name.
“ Attention , Maria Strickler This call is regarding case number 20 2 3 1 1 0- 6 3 5 3 This is David Jones with process server, dispatch And we are making our final attempt To serve a court summons to the Party address Attached to this phone record The documents Choir a sign For proper service and delivery Someone over there Age of 18 must The present and available Contact the insurance agents legal department For further information at 8 3 3- 9 9 3- 4 1 9 7 Failure to communicate with the office will result in And fines under title 18 section 15 oh 1 Full evasion of service…”

Wow it looks like I'm not the only one being harassed by them. They've called my Dad's and Sister's number. Next day called me and I called them back. I asked for their mailing address and my case number. I asked what court they filed at and they said Denton county. I called the county clerk and they have no cases pending for me and the case number I received is not even in the correct format. The clerk said they've been receiving calls from people being scammed for Denton county. The mailing address they provided is 205 Pier Ave, Hermosa, CA. 90254. It looks to be a vacant commercial building. No mention of Montgomery and Associates anywhere in Hermosa, CA.
