    The following describes a government action that has been resolved by either a settlement of a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

    On January 5, 2015, the New York City Department of Consumer Affairs (DCA) announced that a settlement was reached with National Credit Adjusters, LLC (NCA) which has agreed to pay $962,800 in restitution to at least 4,663 New York City residents. The agreement requires the company to stop collecting all debts in New York City, and pay $350,000 in fines. In addition, NCA is banned from applying for a debt collection agency license in New York City for at least six years. This settlement is the result of an investigation by DCA which resolves violations charging NCA with illegally collecting payday loans from New York City residents, engaging in unlicensed activity, deceptive practices, and threatening to take legal action that it could not take against consumers. The agreement obligates NCA to pay restitution to New York City residents that were identified by NCA as having short-term loans with interest rates exceeding New York State's usury cap of 16 percent. As a result, NCA must close the consumer's accounts, stop collection efforts and cannot re-sell the debts to other collection agencies. NCA must also seek to delete any negative information provided to credit reporting agencies, and vacate judgments entered against the consumers.

    NCA must notify identified New York City consumers by mail that they are eligible for restitution. Any New York City resident who does not receive a mailing but believes they may be eligible, should call (855) 798-7654 for a Refund Request Form to return to NCA. Refunds will be issued 30 days after NCA receives the completed form.

    Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

    If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

    Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

    If they are bothering you, report them:

    http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening civil proceedings with no intent to follow through, or threatening criminal process in order to collect a civil debt is a  violation of the Federal Fair Debt Collection Practices Act.)  The same goes for endless telephone harassment.

    Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question.  As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes.  The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question.  Most do not send debt validation letters and many often say they are collecting for someone else.  So, make the complaint anyway if they are bothering you.  Let the FTC sort it out.

    If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

    You'll probably have to yell at them and talk over them.  Tell 'em  no scammy debt collector is going to push you around.

    Today's scammer was someone calling herself "Shonka" (spelling it phonetically, apologies if I didn't get it right).  I've figured out now that they're trying to collect - a second time - on a store card I paid off five-plus years ago, which not only doesn't appear on my credit report any longer due to being, ya know, PAID OFF, but also never even went to collections in the first place.  Would love to know how they get their hands on paid-off account info.

    They call stating that they are wanting location information and if I can call them back to this number with numerous extensions. Personally if someone is wanting to know my location, I need to know what person or business is calling and for what reason. If they just want location information and nothing else then sorry. No call back.

    Calls come up on caller id from random local numbers, with this # as a call back number.    Started in heavy accent her name was Tashawna and Wanting location information on me.   Nope!!!!  Not today Satan.  I know who I owe, and these are not one.   I've blocked numerous numbers they call from,  but they  Do not give up!

    We receive these calls periodically - on the very rare occasions that I answer these calls, the caller is looking for some unknown person, usually from a fly-over state.  Have now blocked the entire 844 area code.
