How can I verify whether or not a debt collector is legitimate?
Here are a few warning signs that could signal a debt collection scam:

The debt collector threatens you. Legitimate debt collectors probably won't claim that they'll have you arrested or claim that they or their employees are law enforcement officers.

The debt collector refuses to give you information about your debt or is trying to collect a debt you do not recognize. You have certain rights to ask a debt collector to verify the debt. You can use this sample letter to request this information. Ask for an explanation in writing before you pay.

The debt collector refuses to give you a mailing address or phone number.

The debt collector asks you for sensitive personal financial information. You should never provide anyone with your personal financial information unless you are sure they're legitimate.
If you think that a caller may be a fake debt collector:

Ask the caller for his or her name, company, street address, telephone number, and professional license number. Many states require debt collectors to be licensed. Check the information the caller provides you with your state officials, or the state in which the debt collector holds a license. If the caller refuses or is unable to provide you with information about his company, or if you can’t verify the information he provides, do not give money to the caller or company.

Tell the caller that you refuse to discuss any debt until you get a written "validation notice." This notice must include:
    The amount of the debt
The name of the creditor you owe
A description of certain rights under the federal Fair Debt Collection Practices Act
If a caller refuses to give you all of this information, consider requesting this information in writing or seeking assistance before paying the debt to make sure the debt, and the company, are valid.

Tip: You can consider sending the collector a letter requesting the information by using one of the CFPB's sample letters. You can also submit a complaint to the CFPB or you can contact your state Attorney General’s office.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know the company or person you are talking with is a real debt collector. Scam artists, like fake debt collectors, can use your information to commit identity theft such as:
    Charging your existing credit cards
Opening new credit card or checking accounts
    Writing fraudulent checks
Taking out loans in your name

Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Submit a complaint with the CFPB or get in touch with your state Attorney General's office with information about suspicious callers.

Stop speaking with the caller. If nothing else works and you believe the calls are fraudulent, send a letter demanding that the caller stop contacting you, and keep a copy for your files.

Tip: You can use this sample letter to write a letter demanding the debt collector stop contacting you. By law, real debt collectors must stop calling you if you ask them to in writing.

Tip: If you're having trouble with debt collection, you can submit a complaint with the CFPB online or by calling (855) 411-CFPB (2372).

    Jennifer Williams
    Dear Jennifer,

I received a phone message on my home phone number for you today. I am not sure why they called for you on my phone number, but here is the message: Brittney Smalls called and said that she received a formal complaint and summons sent to her office this morning. You are given one opportunity to contact the plaintiff to resolve this matter voluntarily. The contact number is 844-246-0220. The case number is: 253983-4765.

I would appreciate it if you would correct the phone number issue.

Thanks your former neighbor Lois Braidi.

I received a call from a Jeremy Ryan who said I had a summons against me and needed to contact the plaintiff to settle it at 844-246-0220.  I contacted my father who is a lawyer, and he looked into it.  When I called this Jeremy Ryan back, he told me that this was for an unpaid payday loan.  This is how I knew this was a scam.  I did take out a payday loan, YEARS ago, but paid it back.  My father said they are payday loan scams everywhere, where they grab your information from the web, and scare you into giving them money.  He wanted me to pay money to avoid a summons, or arrest?

DO NOT GIVE THEM YOUR CC INFORMATION.  Contact the police, if there is a summons against you, it will show in their system.  Google Payday loan scams, and you will see page upon page...

Even if you did not pay a loan back, you will get something in writing.  These crooks would not even tell me who the debt was with just that I needed to call the plaintiff.  The "plaintiff" was the same voice of the lawyer.

Got a call asking for my husband in regards to a legal matter concerning my father-in-law. Since they failed to contact him and we are the closest contact on file, they ask us to give a number to my in-law to call today. They won't give me any detail just said its a serious legal matter that after today, he will have to appear in court and is a serious offense.
I have to then call my husband and then my in-law to find out what is going on!!! I then felt stupid when I read these note here. These crooks are bottom feeder and low life. So annoying. They are the biggest fart and criminal. Is there anything we can do about these people? Can we even call the cops on them?
They called with a blocked caller ID #. So shady!!!

Very threatening and rude people!  They got a hold of our home, cell and work numbers, claiming to have a summons, and this was the one and only opportunity to prevent them from serving it within the hour.  Classic scare scam!  I had to take eight calls from them and delete three voice mails before they stopped.  Caller ID is blocked.

DO NOT CALL THEM BACK OR ANSWER THE PHONE!  These people are complete scammers! They called a friend of mine today and he asked them for their name and he would not give that info nor would he give the company name. They will try to contact you to pay money that you already paid to a different company. They call lots of people that way and try to scare them into paying multiple times. DO NOT FALL FOR THESE SCAMMERS!

I had a call from this number this afternoon looking for a long ago ex.  They said he gave me as a contact name and number and it was in reference to a legal matter.  When I told them that not only do I not live in the same state he does, I haven't had contact with him in at least 7 years, they said they would note that I should not be contacted.  Then, when I got home from work, my husband had a message from this same number, again looking for my ex.  I know it's a scam.  Not only would my ex not have either of our phone numbers, a message regarding a "legal matter" would not be left with someone random like this.  He left a contact name of Keith Baker, phone #844-246-0220 and a case #266669-0145.  Total scam!  Don't fall for it!

Tell them you are reporting them to the FBI, FTC, and State Attorney Generals office. Ask for their business license number and physical address. Ask to speak to a manager. Call them back constantly and harrass them for this information. They will not give it to you and will get spooked with your persistence. They did the same thing to me a few days back. I did what I just told you and the calls stopped. Haven't heard from them in three days

Total scam.  There is no serious legal matter, you do not have to appear in court and there is no serious offense.   All this is made up in an effort to scare some money out of you.

    Report them:

http://www.consumer.ftc.gov/articles/0149-debt-collection  (Vague threats of criminal prosecution in an effort to collect a civil debt is a clear violation of the Federal Fair Debt Collectin Practiaces Act.

Also contact your local attorney general

If they continue to bother you, and you know you do not owe any money,  tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  You might have to yell at the scammer and talk over him or her.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them.

Jeremy Ryan - called my work looking to serve me but would prefer to do this privately at my home.  Said he was a processor/server only and couldn't provide me with any information.  I told him I did not know what this was about, my employer does not allow serving to be done on property.  Provided me with a "pending" case number 266707-last 4# SS#.  This isn't how our court numbers cases.  Wasn't sure what court this was through.  Told me to call 844-246-0220 if I wanted more information.  Ended call by saying that "you have been notified."

Not calling number since everything I can find is that this is not legit.  Just hope they don't call my work again - that is irritating.
