got a call threatening to take action about a payday loan from 2011; asked them to send documentation and they said they did 4 times; don't recall getting notice;  asked why i couldn't find any information on them and was given www.lcmaxwell.com; had two location in GA; caller said they had 4 locations; asked why the number they called me from was recording asking for code given online and that number is a TN number; asked why number they call me from was not number on their website and was told they have phone lines from vonage; first was given 1 day for settlement and then given 5 days for settlement; said they would send an authorization to my email

I just received an automated call saying they were going to debit my checking account for "The Settlement Amount" in two days if I didn't call to dispute. I called the caller ID number and all it does is ask for a code. I called the number left and all it does is ring.

My message was different,  it said they needed a statement regarding a legal matter that I am involved in. The sad part is it is in a county I don't live in and they needed a statement from me or my legal council.

Sounds like you have no idea about how debt collection is supposed to work or your legal rights.  I would suggest you start here and educate yourself before you end up becoming a victim of this crime.

Criminals masquerading as debt collectors attempt to extort money from people by scaring you into believing that you will be criminally charged (they use the bad check or hot check claim a lot) and go to jail, lose your driver’s license, have wages garnished without actually being sued or going to court, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt.  One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them and they can scare that person into paying their extortion money.  They will use the words “Mediator”, “Arbitrator”, or “Law Office” to make you believe that they are something other than a debt collector want-a-be and that they don’t have to follow Federal and State collection laws.  They do have to follow those laws, but they won’t.  They mention that they have received a Fax document, to create the sense of urgency.  They also tell you that if you fail to call them back you are "waiving your right to council", which is pretty much nothing but hogwash.  They also use the “process server” ruse who calls and claims he is going to serve you, but then says you could avoid it by calling another number where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Read up on your rights here and also make a complaint at this government site:  http://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.

Caller ID showed "Toll Free Call".  Female without identifying self or company left message on answering machine to call back 844 282 6439 to speak to resolution specialist or press "0" to speak to counselor.  There is nothing to be resolved and no need to speak to a counselor.  Turning them in to Attorney General, FBI, Do not Call registry, et al,  for counseling that these low grades desperately need!

Also received a call from them, stating that my account will be debited. First that is illegal as I never gave them authorization to debit an account. Second I paid off this account in 2007. How are these scammers getting our information?

I received a call from this company earlier this year, harrassing phone calls. blocked their number because i read the comments on this site that they are a scam. A few weeks ago i received a summons served to my job about a loan with santander that i kept avoiding because i thought they were a scam. i called them back to try and work out an agreement and they would not help me stating that i\ve already been served. If they are calling you, they arent a scam. They are a new legit company!!!!! THEY ARE LEGIT! Dont believe anything on the internet. listen to what they have to say. You dont have to give them information. let them provide it and verify if it's correct. I have a court date in june for this mess. wish i would have talked to them.
