- tracy chavezI received a telephone call this evening from a man who says that I will be brought to court and served paperwork and will be arrested! I told him to stand by while I google this company; as I found that THIS IS A SCAM!!! I found this online...and want to report how awful this is and he said as I told him this is wrong that he will be seeing me in so called court! SCAM and harassment! Had wrong info about me as well!

He stated that within 48 hours a courier will come to my home. If they can not serve me at home they will come to my job. He stated that my supervisor must be present as a witness and a police officer will accompany the courier for safety purposes.

The problem I am having is they are calling my land line phone and my cell phone at the same time. Somebody has got to stop these folks from threatening people. This is not right and they continue to do it. There is nothing like someone leaving messages on your phone stating they coming to get you and if you not home they will come to your place of employment. Make them stop!

- deadheadFirst off, it’s a violation of the Fair Debt Collections act for a collection agency to threaten you with legal action to coerce payment out of you – regardless if they say they are sending a cop to your house or a process server. You should file a complaint with your State Attorney General.
Second, debts are handled in civil court, not criminal court so the police would never come to your house. If they are going to sue you in civil court – in most cases – you will receive a summons via registered mail. Some districts may allow for a process server – if they were coming – they would have your address already and wouldn’t need to call you first. If they ask for your address – do not provide it. If it’s a legitimate debt, they would already have it. If they don’t, that is a red flag.
In many cases, debts exceed the statute of limitations (this varies by state – so you will have to check the limit for your state). Most collection agencies will file a lawsuit expecting you not to appear in court and they will win a judgement by default. Never allow this to happen, if the debt is older than the statute of limitations, you don’t need a lawyer – you can represent yourself and just tell the judge that the date of the debt is longer than the SOL.
NEVER-NEVER-NEVER give anyone your bank or credit card information over the phone. If it was a legitimate debt, the agency has to provide you with written verification of the debt (original creditor (name, address and phone number), date of the original credit agreement, original amount owed, the amount of fees and interest they added to the account) as well as the process to dispute the debt. It must be in writing – which means they mail it to your house (they should have your home address from the original credit agreement so they shouldn’t have to ask for it – never provide that information either). If they say they will not accept a check – they must have a Credit card payment – that is BS too.
If they keep calling you – inform them that they can no longer call you as per your rights under the Fair Debt Collections act. Once you inform them, they can still send you notices by mail (if they know your mailing address) If they keep calling you and won’t stop, tell them you have filed a complaint with the State Attorney General’s office and if it continues after that – threaten to sue them . You can take them to court and sue them for damages if they don’t stop calling once you have informed them not to call any more.
This does work. I filed a complaint with the NY State AG’s office for a Collection agent that said I still owed money on a car loan and they refused to stop calling me. The State AG’s office filed charges against them and the court levied a fine against them.- Caller: Collection Agent

- JoseyI received the same call and my supervisor called them back, the same woman Antonia that I spoke to was the same person my supervisor got when she called them back. The woman was crumbling when my supervisor was asking her questions and she could not answer them. Everything everyone here has said wss told to me I called the sheriff's office and they could not believe the threatful message left on my phone. The sheriff said if it is not on your credit report it is a scam and from what they could tell it was. I am going to complain to someone because this has got to stop

If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them.

- SGLI also received the same phone call as the others above, along with the same threats. No real legal entity would contact you in this fashion. These people are truly scammers and not even scam artists. They failed to leave information on the court they are calling from, which no court would ever do! And above all else never said what type of debt reason they were calling about. THEY NEED TO LEARN A LITTLE MORE ABOUT OUR LAWS IF THEY ARE GOING TO CONTINUE TO TRY AND SCAM PEOPLE. SCAMMERS!!
