They called stating they were going to serve me papers between the hours of 9 am and 4 pm and have a court summon. They also contacted relatives of mine. All calls were made within 10 minutes a female first then a male by the name of Jonathan Miles. Stating I need to call immediately. If they were serving papers then why did I need to call immediately just service the papers! They new what county I live in. I know this is a scam because there messages had different information for each relative. When we called back it said legal dept. No company name.

Spoke the attorney assigned to my case after my H.R. gave me court papers with his name on it as plaintiffs attorney. Said I had to pay off the balance now because a lawsuit has already been filed. I dont want to go pay a lawyer of my own that will charge me an arm and a leg to defend this I imagine. Any advise?

I received a call from these scammers staying I was getting served.  No papers were served.  When someone gets served court papers they don't get a courtesy phone call saying they are going to get served.  You just get served! Additionally, the court where lawsuits are filed may send you a courtesy notice at best to expect the summons and complaint, but they will certainly not call you.  This is a scam, and I have no idea how these people get away with it!

ACTUALLY IF THE PAPERS WERE ATTEMPTED TO BE SERVED TWICE BEFORE AND YOU ARE NOT AT THE LOCATION  THEY MAY HAVE THE COUNTY CLERK OR DISPATCHER CALL AS COURTESY TO NOTIFY YOU OF LAST ATTEMPT. I WORK FOR A LAW FIRM ITS COMPLETELY LEGIT AND THOSE OR PROPER LEGAL PROCESS OF FILING LAWSUITS. GOOGLE IT.

IS IT ON YOUR CREDIT REPORT. VERIFY IF WHAT THEY'RE SAYING IS TRUE IF IT IS THEN PAY YOUR DEBT. BEST ADVICE IS ACCEPT THEIR SETTLEMENT OR RESOLUTION

    >>  I WORK FOR A LAW FIRM   <<

    Oh?

Do you do all their typing in UPPER CASE?

    >> ITS COMPLETELY LEGIT <<

    No, not necessarily.

Legitimate process servers do not call to warn recipients, or to get money from people to stop the process.  They will deliver the notification without warning.  Process servers have many ways of legitimately delivering the documents, and the served person does not have to be at "THE LOCATION" [sic].

Also, if  one is threatened with an "arrest warrant" via a phone call or email, read this:
    http://news.uscourts.gov/warning-arrest-warrant-scam

"The warrant is phony. A valid warrant would not be served by fax or e-mail. It would be served in person by a U.S. Marshal or other law enforcement officer."

"Anyone receiving a fake arrest warrant should contact the FBI or the district U.S. Marshals Office. If there is any question regarding the authenticity of a warrant, contact your district clerk of court."

    >>  GOOGLE IT. <<

    No.
Since you supposedly know all about the law, why don't you give us a legal citation or two, to prove your statement?  You DO know how to do that, don'tcha?

She may work for a law firm  BUT can not write a proper sentence either.  (I seriously doubt the first part of my sentence).  Of course she could be in the same "firm" as Jeff.

    BigA replies to BRIANNE
Assuming you actually do work for a law firm, you must be on the custodial staff cleaning their toilets and emptying their waste baskets.  Did you actually get past 6th grade?  Your sentence structure is about at a six grade or lower level, and what exactly does this mean: "THOSE OR PROPER"?  There is no way you graduated high school and then at least a 2 year college to be a paralegal.  And if you were a secretary and made those kind of mistakes on the forms the real attorney asked you to type up, you would be out the door in a week.

Go out and get a real education, get a real job, instead of trying to make your scam look legitimate.  Extortion is a criminal activity, which makes you a criminal.

WHO SAID ANYTHING ABOUT WARRANTS? YOU'RE DEFINITELY CORRECT ANY VOICEMAILS STATING "WARRANTS" ARE NOT TO BE PLACED ON VOICEMAIL. HOWEVER BEING THAT I WORK IN A LAW OFFICE AND KNOW GOOD AND WELL HOW THESE MATTERS ARE HANDLED WHY DONT YOU DO YOUR RESEARCH BEFORE TRYING TO CALL ME OUT.

THAT WILL TELL YOU WHAT YOU NEED TO KNOW ABOUT PROCESS SERVING. WHETHER THEY BE VIA SHERIFF OR PRIVATE / PROFESSIONAL PROCESS SERVERS.

SECONDLY A PROCESS SERVER DOES NOT CALL TO WARN RECIPIENTS BUT A DISPATCHER FOR THE COUNTY CLERK DOES . TAKE YOUR NOTES AND READ WORD FOR WORD BEFORE STICKING YOUR FOOT IN YOUR MOUTH

P.S. MY FORM OF TYPING IN ALL CAPS HAS NOTHING TO DO WITH ANYTHING. NICE TRY

Um ... you seem to have misread, or intentionally misunderstood the meaning of "Personal Service".

Here, I will use your very own citation to further embarrass you:
"Personal service is service of process directly to the (or a) party named on the summons, complaint, or petition. In most lawsuits in the United States, personal service is required to prove service"

"Under the Federal Rules, substituted service may only be made at the abode or dwelling of the defendant.[4] California, New York,[5] Illinois, and many other United States jurisdictions require that in addition to substituted service, the documents be mailed to the recipient.[5]"

It seems you cannot support your contention that "THEY MAY HAVE THE COUNTY CLERK OR DISPATCHER CALL AS COURTESY TO NOTIFY YOU OF LAST ATTEMPT".  Yes, that may happen in Upper Podunk, USA, but it is not a notification that holds full weight and approval of the law.  Did you understand that the documents must be snailmailed to the defendant in addition to any other "substituted service"?

It seems BigA's opinion of your qualifications and possible job description is correct.

    Summary:
There are NO legitimate conditions under which a mere phone call can be considered as completion of a process service.  If the defendant does not appear in court at the appointed day, they lose by default.

That is a true summary, no matter how loudly you try to SHOUT your misinformation!

They ID themselves as Jones Litigation Services.  Obvious scam.  This Jonathan Miles appears in connection with another scam (see 844-206-0779) and has been associated with something called Winton Legal Services.

This is the scammers address, so far as we know:

Winton Litigation Services,               Phone number 310-943-4350.
    10808 Foothill Boulevard, #160,
    Rancho Cucamonga,
    CA 91730.

This is actually a mail drop.  I can't find a Winton Litigation Services anywhere.

These people are serious law violaters  .  Report them

    See:  http://www.consumer.ftc.gov/articles/0149-debt-collection

Also, if they call you again, tell them you know it's a scam and that you are going to  your local police department and make a complaint of extortion.

Well you're not getting calls and on here whining and crying for no reason... People that take care of their business get the calls and resolve it! The ones that get on here and write their sob stories are the ones who are too cheap to pay them, most likely unemployed, which is why paying your bills is obviously such an issue. Stop trying to run away from their problems  Lesson of the day: PAY YOUR BILLS!
