- Jenn S. replies to John brownI just got a call from 207-307-2137 and in the voicemail they told me I had to call 844-481-2891 due to a civil action lawsuit against my husband. I called and they provide me with his full name and date of birth, but would not give me any other information. Said he had to contact them as it was a "legal matter involving a civil case". They provided me with a case #. This is obviously a scam and we are not going to call them back or pursue it any further. If it was legit we would have been sent court papers. Besides we have nothing outstanding for them to collect on.

So I called it just out of curiosity as I've been getting random calls like this from various numbers for about two years. So wanted to find out what it was actually about. However, after being put on hold forever, a guy asked me to verify my birth date and I said I wouldn't give that out over the phone. He did have my last four digits soc security number but he said unless I provided him a birth date he couldn't tell me what the case was about. So I told him to tell me what birth date he had for me and I would tell him if it was legit but he refused and he would go no farther. Which seems odd to me. They are alerting people that they are going to deliver papers to their homes so why the need to call first? They didn't ask when I would be home or where I lived which would have made sense otherwise. And if they verified the last four of my social why do they also need my birth date to tell me what's going on?

- BigA replies to MikeFirst, a statue is something in a park or a museum made of plaster, marble, etc. A statute is a law. Now the SOL is different in each state. It applies only to the time they have to sue you, not on the time they have to collect, unless you live in Wisconsin and Mississippi at which time they must also stop collection activity.

So let's get to your problem. You post is not written coherently, so it is not possible to give you exact advice. However it is incumbent on the debt collector to prove that you owe the debt, not the other way around. So this is what they are required by law to do now that they have talked to you.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
So if and when you get that letter you must do this immediately:
You need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.

Fortunately we did not pay them any money, but they sounded convincing. After doing some research (this site helped a lot) we determined it was a scam. Be aware of the Maine phone number they also call from (207-217-9683). They became rattled when I finally figured out and told them this was a scam. My wife and I just filed a complaint with the Federal Trade Commission detailing our experience with these scammers. We are educated people and came very close to being scammed out of $511 from this "company" and we fear others may have been scammed. We hope the FTC will stop them soon and no one else is bothered by them in the future.
