- TKF| 3 repliesI got a call from this random person (860-503-8000) telling me that somebody had made a complaint about my mother, who's a senior citizen by the way, and that I needed to call 844-389-4991 give them a reference number which they provided. I sat down with my mother and together we called this number and gave them the reference number. A lady by the name of Kristen said that they were suing on behalf of T-Mobile for an account that was supposedly opened prior to 2004. I knew immediately that this was a scam, especially since my mother has never had a T-Mobile account and any phone she's had has been under my plan. This "Kristen" person proceeded to tell us that they have been trying to collect on this account since 2004. She became annoyed when I started asking her questions like what address information did they have when the account was opened. She gave an address that we haven't lived at in over 31 years. She also said that my mother needed to pay her $1800 today or she would go forward with the arbitration proceeding. I told her to email or fax any documents of proof and she became even more annoyed but she agreed to send them by email (we still have not received any documents yet). I told this lady that I will be seeking legal action because I recognized this whole operation as a scam. At this point she became belligerent and said that she would note that my mother was being uncooperative and refusing to pay and that she would seek judgement against my mother and garnish her work wages and bank account. I reminded this lady that this call was so-called being "recorded" and also informed her that I would be pressing charges for attempting to extort money from elderly individuals and at that point she became outright enraged. I hung up after that. If anyone receives a call like this, please contact the authorities immediately! It is a scam!

- jewel| 1 replythey called me and claimed i owed an unpaid cell phone bill to sprint. i told them it was a lie i never even had services with them. i also told her to quit calling and hung up. she called me back i threatened to report her she said i had no information on her. i again hung up. and miracle upon all miracles she recalled wanted me to take down some information i told her i didnt want it and to do what she needed to do, and she informed me she would call at a later date. i told her not to bother. they had called me once before months ago. they will keep calling where can we report this

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

- Monica| 2 repliesI just received a call from a female Tommy saying I owed $899 for a Sprint account from 2002. I have never had a sprint account. She said" I should have disputed this back then". I told her that I didn't know about this. She said "well it's been in collections for years and on your credit report, if it wasn't your debt then you should have disputed it". I told her I just looked at my credit report and it wasn't on there. She said "well we removed it recently from your credit report as a courtesy". REALLY??? Bull crap! I bought a house after 2002 and was required to handle all collections prior to closing, so I know there was no unpaid bill in 2002. This is a scam and we need more consumer protections! she told me that the statue of limititations only apply to being sued by the company and they can pursue a 10YR judgement from a judge that will allow them (a)to garnish my wages, (b)freeze my checking account, or (c)place lien on my property! Is this true? She said that this debt has my name, address, phone number, and social security number, therefore it belongs to me and I have to pay my debt along with 29.99% compounded interest and fees! I told her to send me proof, and she told me that she sent out a letter to my address 45 days ago and my time to dispute the debt is over.
SOMETHING NEEDS TO BE DONE ABOUT THIS! we need more protection from these practices! debt should not be bought out without there being a contract to prove the debt belongs to consumer. the only thing they will do to prove it's your debt is provide your name and personal information, they don't provide signed contracts to prove anything. REMEMBER THIS IF YOU FORGET ALL ELSE:
1. Legally, THEY must prove you owe the debt (you do not have to prove to them that you do not owe the debt)
2. They must prove they have a legal right to collect the debt
3. They must send you snailmail with specific info within 5 days of the original contact, if you request that validation notice, or if that information was not provided on initial contact. You have up to 30 days to reply to that letter.

Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. Please reply to this post, to let us know you read it, or have taken suitable actions to protect yourself. - BigA replies to MonicaIt amazes me that you ask questions like that when the answer was right here in this thread. We need collection laws? The laws we have work extremely well, if and only if, people like you chose to use them. Did you read my other post? Did you go to the CFPB website, learn about debt collection, and what the collectors can and cannot do? Did you file a complaint while there? Did you go to your State Attorney General's website and learn about your state collection laws? Did you file a complaint there as well? The statute of limitations (not statue like in a museum) runs from the time of last activity regardless of who buys the debt. Once that runs out, no one can legally sue you. Instead of degrading the laws, take the time to learn what they can do for you and what they allow you to do. Then you won't become a victim of this crime, because you will know better.
