- Blogger| 5 repliesOk this is how this is done, normally when you get served the documents are delivered by the sheriff not by some "legal services", If this is not a scam your best bet is to wait until you get served and have the documents checked by an attorney (they do this for free) then after the attorney verifies they are valid you call them back and tell them you want to pay whatever debt it is you owe them and to cancel the court order They will have to do so at that moment but you also will have to be ready to make at least a down payment and ask them for some sort of payment plan.
This was my experience and I was told that is the way it works.

- C| 1 replyI got the exact same call on my cell and home phones, and this joker referenced my married name from over 15 years ago. He claimed to be from some "county legal services" outfit, very vague and generic and fictional. First of all, I have no outstanding debts or any sort of issues, so I knew there was zero validity from the start. Second, official court documents are served by process servers through the sheriff. Third, you do not receive notification that you are being served. These jackholes are using public records to find just enough information to run a phishing scam. Or perhaps they are running a zombie debt collection "agency," purchasing ancient accounts for three cents and hoping to trick victims into restarting a long-dead statute of limitations clock. Additionally, I found that the name "William Walker" is associated with several different scams. In any case, please be careful, and do not give ANY information to anyone over the phone until you verify their legitimacy. The criminals are "working" hard to steal whatever you may have, and they prey upon fear and ignorance.

- Angry Lady replies to Not falling for itI just received a call from 844-549-9619 saying the address was 178 Santiago Way, in California 92093 was the zip code they gave. They were so rude because I started to ask questions and started to hang the telephone on me but I continued to call back over and over again. I even googled the address and nothing came up for San Diego, California were they claimed to be based out of. They are evening calling family members telling the if I don't call in 1 hour I will be arrested how they getother numbers I don't have a clue. This is very upsetting though. I told them Morgan and Associates was based out of Oklahoma and I couldn't find there address and they told me they stand alone.

More often than anyone admits, creditor lawsuits are defective enough somehow to be challenged. A decent consumer lawyer will not let her client simply "pay whatever" is demanded without shooting holes in the claims or, a vital point you've neglected, reviewing the plaintiff's pre-suit collection efforts for any statutory violations to use as weapons. A more pedestrian consumer attorney will slap out a templated settlement and make it sound like "such a deal" you've made with a plaintiff who may deserve to pay *you* instead.
None of the debt collectors I've sued wanted to lay down without a fight. Why should you surrender just because you're the one named "defendant"?
