And if I wanted to settle out court to call the plaintiff at the above number. If you are getting a summons to appear they don't call you in advance. I think it's a scam.

He says I have neeb served with a summons for a civil complaint (which I have not) and that I have 24 hours to avoid further legal action, levies and penalties. Has anyone had anything happen?? I have debts, but have no idea what this concerns.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
* Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed ... not emailed or texted]

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.

This person says his name is Sean Patrick sounds very aggressive over the phone and is saying I'm being sued by plaintiff US DR he demands I call a number he left on the message. Does anyone know if this is a scam. I also keep getting automated messages by a computer voice saying that I should call them to settle the civil lawsuit out of court. They also say that they will get a warrant for an arrest.

- Not ImpressedI got a call from Shawn Patrick (boy this guy gets around!) also. Tried to sound threatening..."civil suit being filed"-- saying I had until the end of Monday to call this number. What a crock! First: who calls to "warn" you about a lawsuit?! NO ONE!! They would be sneaky so they could physically see you to hand you papers (ie. being "served"). Second: Let's say someone did want to warn me..for some crazy reason...would they do it on a Saturday morning and say to call them by Monday? Ummmmm....NO. This is a desperate last-ditch effort to collect a debt that no longer appears on my credit report because its so old. Here's the thing, though...if I call back, if I speak to these people and acknowledge that old debt...they can put it BACK in my credit report. DO NOT CALL!!! Get your annual credit reports from all 3 credit agencies: Experian, Transunion, & Equifax. Most offer them free once a year, but even if you have to pay a fee (I paid $10.00 for my Experian report) it's totally worth it. KNOW WHAT YOU OWE!
- Not ShawnI received three voicemails from this number from a person named Mike Davis. Something about a pending civil lawsuit in Bristol County. I actually called the number and said they had the wrong person. Supposedly they are going to remove me from the mailing list. We will see.
- Jocasta replies to KevinYes, I just received a call like that. the person said that they were going to issue a summons if I didn't contact them with in 24hrs. I checked with my county clerks office and they had no record of any court action. I've written them to provide proof of the debt, and I pulled my credit report, there was no record of the dept. The debt had expired. They're just harassing us. If you send them a letter requesting proof of debt and to not contact you, except by mail they'll have to have to comply.
- CWG40 replies to albertoYes it is a scam. If you were the subject of a law suit you would have already received written communications from the attorney for the other side. There would been attempt at negotiation and there would be a paper trail. You would not receive the information from a threatening debt collector. This is total scam.
Being in ordinary civil debt is not a crime ad you cannot be arrested for it. Judges issue warrants and they are only issued to duly constituted law enforcement officers. NOt to to debt collectors. Debt collectors have no influence on what the criminal justice system is doing, period. - CWG40ID themselves as US Debt Recovery.
