- Tygerkat replies to Chornay| 1 replyIf you owed a bank from 2008 the bank would have been in contact long, long ago. They certainly would not have waited 13 years to send a debt collector after you.
- Chornay replies to TygerkatExactly. When I called the bank, they found no record of me. I even told the "collector" that I never got a collections call or letter. Why would they wait so long. I left this bank in good standing and signed up with another. The bank agent told me that I would not have been able to go to another bank if I was in arrears (had a negative balance). with another. I had never had a credit line or credit card through them.
The fraudsters gave me a case number of the "lawsuit" not knowing all cases are recorded publicly and can be looked up. NOTHING.
The idiot fraudster said that she was able to go to the DMV to pull up a copy of photocopy my actual license. Impossible and illegal. Only cops and governing bodies have that ability.
I was referred to the credit counselor by a mortgage lender.
I believe that my information was then sold to a 3rd party by a "credit counselor."
Not even a week had gone by after I submitted my info to this counselor, I get this random call treating to ruin my credit and asking for $6000. They are trying to tell me that I am being sued unless I pay $14,000 .... Watch out folks, these research stuff, call family members and try to make it as legit as they can. I'm a bit too smart for their tactics though. They need to see a prison cell for a few years

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

They gave a file number and said it was “notice of intent to advise of civil complaint. Spoke to a lady saying that bank of meridian is trying to get money from a credit card that was not paid in 2001. And someone did make payments for 5 years but stopped. I know owe 9,000 and she said that maybe a family member had this card and that was common. She knew my social security number, previous addresses, car in my name, and said the by November 1st someone will be serving me to show up in court!
