I couldn't understand what law firm he said, I only understood the callback number, which is long distance so I won't call them back anyway. He claims the matter is urgent. Yeah right. If it is so urgent, then they can send something in the mail.

Send them a letter, certified mail return receipt requested, and tell them that it is inconvenient for you to receive calls at any time and to only communicate through U.S. mail. If they call after that, then they are breaking the law, (the federal Fair Debt Collection Practices Act) , so save any further phone messages, and take photos of the caller ID in case you need to use it against them in court.- Caller: Law Office of Bradley J. - Joe replies to JoeBy the way, don’t put your signature on any letters that you send to a collection agency! Signatures have a nasty habit of jumping from one document to the next. They can easily photocopy your signature onto clear plastic and then overlay that clear plastic on an official document and photocopy that to make it look like you signed an agreement or something. And remember this: 100% of bill collectors lie 100% of the time, so don’t believe anything that they say. I have yet to come across an honest bill collector (I’m being harassed for the bills of the person who used to have my phone number, I have NO bad debts of my own!)

They want get you there address or nothing they have a bad rating with the BBB. He use threat saying that is going to take me to court if I don't call him back..What can I do about these phone calls?

- Joe replies to ShelliI hope you have those calls recorded! They are golden! Those threats to take you to court are against the law unless they actually follow through (which they probably won’t.) Familiarize yourself with the federal Fair Debt Collection Practices Act (do an Internet search for FDCPA.) Also, send them a demand for validation at the address that I listed above (this phone number is for the Law Office of Bradley J. Rephen.) Also, go to the Credit Forum at http://creditboards.com/forums, and read up as much as you can, they will help you get these jerks off your back! This office needs to be put out of business, permenantly! Know your rights and protect and fight for your rights! You have the right to not be harassed by these goons!

- StellaBlue| 11 repliesI received a call from Brad Rephen saying that I owed over $1100 in bad checks going back to 2002. He said I had to send $500 by 7 pm today or they would have me arrested tomorrow. He said they would accept the balance in two weeks. He said I would spend 3 years in jail. I swear I paid these checks. There may be one outstanding, but that is it. Problem is, you pay bad checks with money orders and I don't have the receipts. Stupid of me, but I just figured I'd taken care of it and it was a done deal. NOw this guy is threatening me. I have nothing in writing from them. I'm going to send him a certified letter telling him to send me more info (this is the advice I've read on these postings). I googled this law firm and there are several posts on various web sites/forums about Rephen Law Firm in New City, NY, and this appear to be their MOA. BTW, his phone number is not showing up on my caller ID, only "caller unknown" so they must be blocking it now. The number he told me to call was 845-678-1278.

- Joe replies to StellaBlue| 1 replyPlease tell me you have that call recorded! It is extremely against the law for him to threaten to put you in jail! You can not be arrested unless you are criminally prosecuted or fail to show up for court! You can now sue him for at least $1000. If you have proof of the call, then call a NACA attorney immediately and sue him! You will win. And many attorneys will take your case without any money up front and you usually don't have to pay them unless you win. By the way, the federal FDCPA says that Bradley J. Rephen will have to pay all of your attorney fees too! Plus you’ll get to pocket a nice sum of money. It doesn’t matter whether or not you actually wrote the checks, you can sue him and win! Now please go to that forum that I listed above and let them know your story, they’ll help you put this baboon in his place!
- Joe replies to StellaBlueAlso, by the way, since you have now spoken to him on the phone, he is required by law to send you a notice by mail within 5 days. If you fail to get that notice, then you have another violation against this moron. Also, stay off the phone! Everything should be in writing! If you ever get a collection call again, hang up immediately after you find out who they are and send them a DV and limited cease and desist letter (meaning that you are demanding validation of the debt and that phone calls at any time or place are inconvenient. This will invoke protection for you under the federal Fair Debt Collection Practices Act and allows you to sue him for violations of that letter.) Now, please, go get these jerks!
- Joe replies to StellaBlueAlso, if these checks are from 2002, you are more than likely past the statute of limitations (check the laws of your state.) If that’s the case, then there is absolutely nothing that he can do to you. He could still sue you, but you’d have an affirmative defense in court. He’d lose!

Also be assured that all this idiot is doing is trying to scare you into paying, and he is breaking the law by doing so. Don’t believe anything he says! This guy is so crooked that he’ll even try to get you to pay for debts that you don’t even owe! Trust me. Don’t let them scare you. Fight Back!
- Helena| 1 replyMark Cooper called me today about some bad checks he said I wrote that have been turned over to the Virginia Attorney General's Office and he has been retained to collect. I asked him to send me a letter and proof and before I even finished my sentence he told me he didn't have to send me anything. I had to fax him my proof that I didn't write them. He told me I needed to pay my debts and this is what happens when you write bad checks. I told him I didn't write any bad checks but he didn't want to hear what I had to say. He did give me a fax number, his name and a phone number. I called a friend of mine who is an attorney and she said to google him and here I am. This guy had me very upset, to the point of tears. I asked him several times to stop speaking to me for a minute and he just would not quit. He got louder, I got louder and finally he shut up and let me speak. Not that it helped. Finally I told him I would let my attorney handle it. He wanted to know if he would be hearing from him today!! It was after 5:00 PM. I said no but I would be speaking with him tomorrow. He hung up.

- Joe replies to HelenaMark Cooper is wrong. He has a legal obligation to prove to you that you wrote those checks. It is not your job to prove that you didn’t write them unless he can provide you proof that you did. He now has five (5) days to get you something in writing, or you could start litigation against him for failing to abide by the federal laws of the Fair Debt Collection Practices Act.
I wouldn’t suggest starting litigation yet, however. Let him rack up the violations (and he probably will), and then nail this [***]. You really need a NACA attorney who is experienced in this area. It is very easy to lose a case if your attorney is not experienced in this sort of thing (I don’t know whether your attorney friend is NACA or not.) A NACA attorney will nail these guys to the wall!
Be assured that this guy is only trying to scare you into paying. If you really didn’t write these checks, he probably knows that and is just doing anything he can think of to get you to pay, even if it means breaking the law. He is scum of the earth, and just wants money. Most debt collectors have a ton of bad debt themselves and just want to pass on their frustration to you.
By law, this goon needs to provide you written proof. You must request this written proof in writing to protect your rights. Do so by sending a DV (demand for validation) with a limited cease and desist letter (telling them that it is inconvenient for you to receive phone calls, and to keep all communications to US mail) CMRRR (certified mail return receipt requested.) Remember to type your name only, do not sign the letter!
By the way, stay off the phone with these guys. Do everything in writing. Don’t be worried because there is a good chance that these guys could end up paying you for violating the law! They need to learn how to behave, and we all need to do our part to punish them! - PAS| 4 repliesI received a call yesterday from Steve Tucker, telling me I had to contact him regarding an URGENT matter!! I returned his call but got voice mail so I left him a message, he returned the call this morning stating I had a check returned over a year old for 15.00, he told me unless I paid him 165.00 for the check he was going to sue me. I contacted the original company, and they could not help me. I contacted the supposed recover company, and they could not help me, I asked to receive a statement or a bill, itemizing how a 15.00 check could end up 165.00 he told me he WOULD NOT send me a bill, fax me a bill, that my old bank statement was proof enough and if I didn't pay by friday (the next day) at 5pm he would be suing me. Once of my co workers suggested I check out this company on google, THANK GOD I DID, I immediately called "steve" back and told him I would NOT be making a payment to him at any time, in which he became absolutely outraged, yelling and screaming at me, he kept calling me. I told him to by all means go ahead and file suit, cause I wasn't paying a dime to him. When I had told him I had looked up on google.com his company he became even more enraged, stating he didn't give a crap what a few people on some stupid internet site said, he's been in business for years!! I see now by the "people on this website" I am not the only stupid person out there!! I am in Nebraska, and I see he's not licensed everywhere so I was wondering is he licensed debt collector in Nebraska??? Just curious.

First rule – stay off the phone! Secondly, chances are that he will NOT file a suit against you in Nebraska! It wouldn’t be worth his time, especially over 165 measly dollars. Now, that fact that he threatened a lawsuit is against the law unless he actually follows through with that threat (section 807{False or misleading representations} of the Federal Fair Debt Collection Practices Act.) The unfortunate thing is, unless you have the conversation recorded, it never happened. You need proof in court and it is your word against his. You are in Nebraska and he is in New York. Both are ‘One Party Consent’ states - meaning that you have a legal right to record a conversation with him without his permission or knowledge. If you must speak to him on the phone then make sure you record it! I’m not sure if he is licensed in Nebraska or not. You may want to check with the Nebraska Department of Commerce to see if he is licensed, or if he is required to be licensed. He is by law required to provide you proof of the debt if you request it in writing. Send him a DV immediately! If you have evidence of him breaking the law, then talk to a NACA attorney to see if you can sue him! - carrie tarvin replies to StellaBlue| 5 repliesI seriously doubt that Brad called you and was nasty - some of his employees maybe, but not Brad - I have to say that an employee of his was nasty to me but as soon as I got in touch with Brad himself, he was the most kind and gentle of men. He has a lot of terrible people with nasty attitudes to deal with, but he was great with me. If you will remember that most of these people do owe the money and do not want to pay it, he has to prosecute people every day who refuse to cooperate. Believe me, he will show you respect and he also deserves respect as well. It maddens me to hear bad things about Brad himself when you might have a bad experience with an employee of his. If you will contact him and explain the situation and PAY what you owe, you will be happy. Remember that some of these liars on this web site are mad that they have been caught and just want to try and destroy someone who is just doing their job!
