- ChristineI got a call too. They called my work to say they wanted to serve court papers on me. Then they gave me the number 855-207-9500 to call. I talked to someone named Greg Taylor who said I could either be served papers and possibly pay $2,500.00 or pay a settlement of $409.32.
- MoonDance1962| 10 repliesUpdate: I haven't heard back from the "process server" so far. I did some research and found the company address: Liberty Capital Services 828 W. Town & Country Road Orange Ca 92868. First they had someone call my job pretending to be a process server. They asked what the company policy was regarding serving legal papers to an employee. Then they told my boss the papers were for me after he wouldn't really give them any answers. They gave him the phone number and told him I had to call to stop the orders to have the papers served. I called the number and spoke to a Gary Taylor who said I was being taken to court over some unpaid overdraft charges from back in 2005 with USBank. He said I would be sued for additional fees & interest and legal fees on top of the bank charges which totaled about $2,500.00. Then he said he could offer me a settlement of $409.32 if I paid right then. I told him I didn't have the money right then and would have to get back to him. At first I kind of believed him but, after I calmed down, I did some research and what they're doing is illegal. Process don't call to set up a time to serve you. They just come and serve the papers. Also, once court papers have been filed, it's impossible to "stop" the process. You have to go to court and drop the case. I've reported them to the Federal Trade Commission. If anyone else has experienced the same problem with them. I suggest you report them to the FTC as well.

I wonder who they are. I don't know how they got my brother's number. I will turn them in to the FTC also, I think it's harassing.

- Julie| 4 repliesThank you so much for the info. I also had a bank account with US Bank. What a piece of $%!+ bank. My account was overdrafted by less than $1 and for less than 4 hours.. By the time all of the service/overdraft and whatever else fees were added, my balance became over $700. I will NEVER pay these people. I dont care if I win the lottery.
I had a feeling this "lady" was a debt collector. You can only serve a complaint on paper. Personal service or substituted service ie: certified or regular mail with approval. If I didnt know anything about the legal process, I would have call this stupid number back too. I also know that if the debtor initiates correspondence with the creditor (calling them back), that re-instates the lien period of 7 years. So DONT CALL THEM BACK. They can renew their debt on your credit report if you do.

Think about it, if you had paid the bill you wouldn't be getting a call from an agency who just bought your account from a bank who you just gave your tax money to because of the fact that you didn't pay your bill. You shills always have a critical problem with reading comprehension, which says it "doesn't take a genius" to be hired at hostile collection agencies. Monica said she had *no account* with the creditor. Even putting aside the illegal tactic of a collector making sham lawsuit threats and being deceptive in general, the named bank would not be the real party of interest. A collector going to trial on that would risk sanctions and fury from a judge and a nice payout to Monica the victim.
It takes very little perusal of these forums to find many others who must endure similar [***] collection calls for total strangers, for accounts already paid, accounts discharged in bankruptcy, accounts with no chain of title, accounts too old to sue over, and "debts" made from thin air. Meantime you and your boss and his kind wish to "weasel your way out of an obligation" to obey state and federal laws written to curb your natural thieving tendencies. - Resident47 replies to Mark Estrada| 1 replyThat's what sucks out our economic confidence, angry trolls like you who think all bills are legitimate. Think about it, a debt collector which resorts to extortionist tactics likely has no proof of claim, having purchased a huge package of distressed accounts at a fraction of face value with next to nothing for documentation.
The accounts originated with banks that decided long ago they can make more money pushing people toward default and charging penalty fees than actually building customer trust and loyalty. Rather than put our generous bailout donations toward the most helpless among us, they helped themselves to more mergers and more bonuses to executives while renewing their campaigns to punish consumers.
In the back room we discover that large name brand financial firms underwrite and seed some of the worst high volume collection agencies, removed just enough steps to make the connections less obvious. So you see, it's all just a Möbius strip effect which entraps consumers into either paying out with no end or go broke trying. Lesson for today, do your homework!

He said he was looking for a woman named "Iris [my-last-name]" and to call them regarding the action they were taking against her and to reference a case number. He did not include his company name or any other details. --- I cannot think of anyone anywhere in my family tree with the name Iris (or anything that sounds remotely similar to Iris)!

- BrandonI got a call tonight from this guy and on the message machine it said to call back this 866 number claiming my wife was being taken to court over an overdraft bank charge from 2005. This is 2012! and my wife didn't even work that year much less have a bank account. Something very fishy here and i think its a dummy bill collector making up a false claim. I don't have one minute for these clowns.

This company does not have an attorney, nor do they actually pursue judgements like they claim. They are a fly-by-night collection agency simply using scare tactics to make people pay their debts. Mind you, I will defend them to the extent of knowing that the debts they purchase are still valid debts within the statute of limitations, but they are debts owed by low-life individuals who have no intentions in paying back their obligations. If you do not owe at least $5,000, and have no available assets, then I would not worry about a thing. NO company is going to pursue a judgement on a debt under $5,000 due to the fact that the associated filing and legal fees are too great to do so, and it will not benefit them to go after you for a $500 credit card that they most likely don't even have the original contract on. In the event any of you receive a phone call from these people I urge you to contact the FTC and your states Attorney General to file a complaint. Be sure to get as much information as you can on the initial call from these people, address, name of person you spoke to, etc. On another note.....A PROCESS SERVER WILL NEVER CALL YOU BEFORE SERVING YOU! There are several attorneys who specifically work on shutting down agencies like these. So, again, if you receive one of their threatening phone calls, have no worries. Just contact the entities I have listed as well as an attorney to consult with him as to what you should do. I will say though that I do agree with paying your debts and not running from your obligations. Our economy, and the USA in its entirety would be a better place if everybody did just that...PAY YOUR DEBTS!
