    Caller asked for me (last name close, but incorrect) and i said yes,  thats me. He then told me he has a legal document stating i owed $3200 . He told me  i could avoid legal fees if i settled with him and would be stopping by. I looked thru some old documents and still haven't found anything i could have charged with that amount. Guy sounded pleasant over the phone, so hopefully i'll get this resolved and avoid court or more legal stuff.

    You believe these people! Guy says i have a defaulted loan in collections, but i dont have any loan i told him. He insisted i do and will come by to 'serve' the papers. I told him he better come with the cops cause i dont owe anyone anything and if someone comes to my house saying i owe something i dont, they will find what i have to give them isn't in the form of money!

    I received a treating call from a locater service stating I owe a payday loan Great Plains. I have no documentation and they already have taken 169.32 out my account. I think its a scam I feel stupid. Please help ...they say their name is continental processing. Phone number 18883441855 ext312  Mr.Brown

    The first thing you might want to do is find out HOW they got the money from your account if you did not authorize it. If you didn't , file a fraud claim with your bank and dispute the charge!

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  


    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    They have called and threatened me with serving papers to my home. This company is such a scam to get money from people. I would sign for these so called papers if it was legit. You can't serve those kind of papers without a police officer present especially if it's a fraud charge or something serious like that. They also called from a local number where I live so I would be more inclined to pick up the phone. I told the guy you can bring the papers and Im gonna call the cops.
