You are so right, made an accusation that I had tried to commit fraud of a financial institution and also there will be a civil case as well for a dollar amount...And he asked if I had sign the papers that were to be delivered to me...I asked him who was it that I was supposed to have tried to commit fraud against or with and he did state Advanced America...I told him that I was calling my lawyer and I would have him to contact them, he said "yea" .  There were a lot of more questions that I could have asked him, especially with him threating me with bogus legal accusations.

Received a call threatening legal action was being taken due to fraud from 855-230-0436. They said there was pending litigation against my social security number. I have only one chance and must call back within 72 hours or somebody will be at my residence or my employment to serve papers. They gave no company name, no caller's name or any specific information.

This is a common ploy by criminals masquerading as debt collectors who are attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this,  all for an alleged or nonexistent debt.  One of the tricks they use is to call your work place, friends, or relatives repeatedly in an attempt to shame you into paying.  They also use the “process server” ruse who calls and claims he is going to serve you, but then says you could avoid it by calling another number

Thanks BigA. Good info. here. My question is how do they get all their info. to begin with? Then how do they get other family member's information? They have also contacted my family members. I called the number EARLY yesterday morning from another phone to see what kind of voice mail I would get and they wouldn't recognize my number. No voice mail ever came on. There was just a click. Then, a few hours later, they called me at the number I called from. Said the number was not in their 'system', proceeded to threaten me some more and when I refused to cooperate he said he would take my number off the 'list'. I don't know if it's a debt collector or not. They said my son had used my phone number and wanted to know if I wanted to get him out of trouble. How can I find out if this is really legitimate?

They do research.  Put your name in a search engine and see what comes up.  Pictures of your home, people you know or might be associated with.  They get information from places that have been hacked and they soft pull credit reports.

Law enforcement doesn't call you you to tell you that you committed fraud or any other crime.  If there are charges to be brought, they bring you in and question you or arrest you.  No debt collector can bring charges.  Use the information up ther to learn what you need to know to prevent yourself from becoming the victim of a crime.  It sounds as if they are already scaring you into thinking you can pay your way out.  That isn't how extortion works.  Once you pay you keep paying.  They will also then sell your info to other crooks as an easy mark.

    Victim of Scammers
I have been receiving calls and so have my friends and family members stating that I defrauded a bank . I have done no such thing. I called the police and they said this is a common fraud but they still keep calling me and my family. It is very embarrassing. I spoke with Jake Wilson today from Legal Services and he said he doesn't want my money he just wants me to know there is a legal case against me. That it could be that I was scammed. I said I will not give you any of my info and I have already called the police and he said that is fine because they are a legal company. I am very worried about this. Why won't they leave me alone? I have not defrauded anyone and this is very violating.

I received the same call from Jake Wilson.  Being in the legal field for over 25 years and handling credit issues for a huge retail company, I can tell you this is a scam.  I've been a victim of identify theft 6-7 years ago and I still get these stupid calls.  First of all, the numbers used are not true numbers of the caller.  They're "spoof" numbers.  That's not legit. Second they have scripts that include big words (the caller probably doesn't even know what they mean) that they are coming and there's sanctions against your SSN. Actions are not taken against your SSN. Your credit would get ruined, but nothing happens with your SSN.   If a company is truly going to bring a lawsuit against you, they would not tell you they are coming.......why would anyone then stick around and wait to be served a lawsuit?  If they can't serve you, they cannot proceed litigation against you.  Proper notice has to be given to the defendant.  Again, a legitimate company would not give you notice ahead of time.  They just don't do that.  Even if you did get served with papers by a slim to nil chance, it has to be at least three business days before the court date.  You also have the right to ask for the documents you have signed that shows you truly owe the debt they claim you owe. They have to have documentation proving you owe the debt.  I've had calls to my brother saying they were on their way to my house to serve me.....never happened. I was served once (without getting prior notice) and when I called them and asked for the original documentation showing my signature, they said they didn't have any.  It took several trips to the courthouse before the attorney asked that the case be dismissed because they didn't have documentation and I was awarded monies for my time and court fees I had to pay to officially appear before the Court.

Just remember, you are the one in control, not them.  They need to call from and provide a valid phone number of a valid company if there is any chance of the call a legal call.

Some stranger called you and told you that you owe money for some debt?

If that happened to you, did you check your credit report to see if the debt actually exists?  (You can get up to three free credit reports a year).  Did your credit report show the debt was written off, or was the call from the original creditor?

If the debt was written off, that means the original creditor is trying to recover their tax liability, and they have sold your debt to some collector, for pennies on the dollar.  This is usually called a "charge off" or a "write off".

You may still owe the debt!  If you received a call from the collector, your next step is to assure the collector that called is the one who currently holds your debt.  FDCPA rulings state that collectors MUST snailmail (USPS post) a "Validation Notice" to the debtor within 5 days of the original contact.  If you do not get that Validation Notice, the phone call was probably NOT from the current legal holder of your debt.

By law, collectors must not make certain threats, such as sending you to jail (debt is a civil matter, not a criminal matter).  The collector also must not promise to return your credit report to where it was before you stopped paying the debt (the "charge off" or "nonpay" statement will usually remain on your credit report for seven years).

If you owe (or owed) a debt, and if you have been called by a collector, you really need to take some time and read the information here:
    https://www.consumer.ftc.gov/articles/0149-debt-collection

You really should pay any outstanding debt ... but assure the payment goes to the legally authorized person or company!
