- Linda| 1 replyMy son received a call, woman said he owed a payday loan from 2016. He did not do a payday loan. They had his social, and knew his address (he moved there in December of 2016). Supposedly the loan was taken out in February of 2016. They said they were going to contact his employer (which he has not worked at since 2014). That they were filing charges against him He contacted an attorney, attorney said it was a scam. I called the number today to get their mailing address so we could send them a cease and desist letter. They would not give it to me, the woman hung up on me 7 times.

- BigA replies to LindaWhenever someone tells you that they are a "lawyer" or that they work for a lawyer or law firm, the first question you should ask is what state(s) they are registered in and their BAR number for that/those state(s). Then go to that state and check them out, contact them directly using the information in the state registration, as these crooks have been known to research real law firm names and attorney names and impersonate them.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

My husband also received a call from the same number and they left a voicemail stating they were filing charges in wagner county on my son and we should let him know. and he should contact them immediately. I am going to keep trying to get their address and full name of business. Garrett never got any mail from anyone about any debt. This is just crazy

And its said to be with federal credit union of publix..first off you must be a publix associate to par take in the bank at question.i am and always will be always have been a construction supervisor. This wont stand.
